Hi Seniors,

At present ,I am a PR and will be eligible to apply for citizenship in May 2021.I plan to marry an Australian citizen and move there for good....am flexible to move in 2021 or 2022 as initially my wife would be coming to me in Canada to stay ad I dont want to jeopardize my Canadian Citizenship.

Pls advise ::
-Inorder to make my wife's initial transition to Canada faster and easy ,should I get maried in Canada or Australia ?

-Will she be eligible to work in Canada after wedding?

-When should I move to Australia from Canada?..... after filing application for Citizenship or after getting in citizenship?Keeping in mind that I dont want to jeopardize my Citizenship process.

-Will I loose my Citizenship if leave Canada for forever?...are there any conditions I need to satisfy to maintain it?

-Does leaving Canada (after becoming a citizen) effect my future eligibility for medical and old age pension or other benefits ?

Best Regards

If your (wife) wants to work in Canada you guys should get married in Canada
working in Canada requires a legal status like work permit/PR card (or Citizenship)
you can move to Australia with you application is in process but you will have to inform CIC (as you have to appear for test/interview and oath)
by my understanding you wont loose your Canadian citizenship (but experts can advice you better)
YES leaving Canada will effect your eligibility for medical and old age pension and benefits unless you file foreign income tax and contribute in RRSP every year, different provinces require certain duration to be physically present in that provence in order to qulify for free medical .

Doesn't matter IMO. Your wife will NOT automatically get PR or citizenship anyway. If you are a PR, you'll have to sponsor her while you are inside Canada. Citizens can sponsor spouses while outside Canada. I already discussed this in one of my previous answers to your question. Before the pandemic, the processing time for sponsoring a spouse was around 12 months.

-Will she be eligible to work in Canada after wedding?

She will NOT be eligible to work until and unless she has a legal status in Canada (work visa / PR / Citizenship)

-When should I move to Australia from Canada?..... after filing application for Citizenship or after getting in citizenship?Keeping in mind that I dont want to jeopardize my Citizenship process.

Once again... Already discussed in my previous answer... You can leave whenever you want - Just make sure you'll be able to come back for test / oath, respond to any additional document requests and maintain PR status until you take the oath.

-Will I loose my Citizenship if leave Canada for forever?...are there any conditions I need to satisfy to maintain it?

No. However, your citizenship can be revoked under certain circumstances.

-Does leaving Canada (after becoming a citizen) effect my future eligibility for medical and old age pension or other benefits ?

Normally, to get old age pension from inside Canada, you should have resided in Canada for at least 10 years after age 18. However, if you are claiming old age pension while living outside Canada, you should have been a resident of Canada for 20 years. Some exceptions apply.

All the details / exceptions are available

Hi Rajamohankamal,

Thanks for your detailed response.

Sorry I dont know the full form of abbreviation of IMO..would appreciate if you expand it for me.

Regarding my wife initial transition to Canada::

1) Since she is Australian citizen and can come to Canada on ETA (electronic-travel-docuent) which allows multiple 90-day visits(as per my understanding) So is it okay that she comes as a visitor on ETA and we get married in Canada during her visit....and then she continues to stay in Canada till the PR file is being processed ?

2 ) From your talk I understand that its more advisable to apply for her PR while I am myself in Canada ,irrespective whether I am a PR or Citizen ,that does not matter.Am I correct in my understanding?

3) To add to the complexity is the fact that we both are from India and would like to get married there. And after that she comes to Canada on short visit on ETA and then we follow the process you may suggest for my queries indicated in 1) and 2)......is that workable?

Sorry for these complicated questions.I am really trying to juggle inorder to avoid time delays and complications.

Hi Rajamohankamal,

IMO = In My Opinion.

She can come here and you can get married but there is no guarantee that she can stay beyond the authorized stay just because you guys got married. To be more precise, there is no guarantee that the temporary stay period will be extended AFAIK.

2 )
From your talk I understand that its more advisable to apply for her PR while I am myself in Canada ,irrespective whether I am a PR or Citizen ,that does not matter.Am I correct in my understanding?

As a PR, you don't have a choice, it must be from within Canada. So if you are applying now, yes, you must apply when you are inside Canada.

3) To add to the complexity is the fact that we both are from India and would like to get married there. And after that she comes to Canada on short visit on ETA and then we follow the process you may suggest for my queries indicated in 1) and 2)......is that workable?

I'm confused. In 1), you mention about getting married when your fiance is on a visitor visa in Canada. In 3), you mention about getting married in India. Which one is it?

Sorry for these complicated questions.I am really trying to juggle inorder to avoid time delays and complications.

If you have a court wedding in Canada and your real wedding in India you could run into trouble especially if it is an arranged marriage.
