Status after quitting job on an active temporary work permit?

My husband had a temporary work permit that was attached to an LMO. It was scheduled to expire in February, 2015. Due to unmanageable work conditions he had to quit.
What is his current status in Canada in this case?

We've applied for the spousal sponsorship/PR, and open work permit. So perhaps he's on implied status?
We are hoping he's eligible to be granted an open work permit with the new pilot program...

He definitely can't work without new LMIA and work permit. Implied status isn't applicable here.

Anarsoul - you are absolutely correct. He is unable to work without a new work permit.

However, I just spoke with a rep at the CIC call centre and they told me that his status is still Temporary Worker until the expiry date of the current permit even though he is no longer working there. Once the permit expires, he will be under Implied Status.

Implied status is eligible for the open work permit spouse sponsorship pilot program.

Hi Airheart,

Please understand that closed work permit authorizes your husband to work only for employer who obtained an LMO. If your husband quited to work for this employer - work permit is not valid anymore. Anyway, implied status can be applied only if your husband's applying for work permit extension for the _same_ employer under the _same_ conditions. Your husband will be eligible for open work permit if you sponsor him for PR (due to recent changes made by CIC), but he can't work until he obtains this work permit.

Please also keep in mind that working illegally may cause rejection during PR application in future.

I see some what misleading information here. Quitting a job or being laid off does not cancel a work permit. Theoretically, you can join back at the same employer if it works and is with in expiry of permit.

Your status is the same as of the work permit holder, until the expiry of the permit or issuance of another permit.

However, you cannot work for another employer without a new LMO or another form of permit.

So bottom line, your status is legal to stay in Canada. You just cannot work for any one else. You might even be eligible to apply for benefits given to people out of job, whatever they are. Similarly your health card or any other services remain active till their expiry.
