Getting married next summer in Serbia ( I'm Canadian ) and I read here http://international.gc.ca/about-a_propos/authentication-authentification_documents.aspx?lang=eng&view=d#A4 that I need to check with the embassy to see if its required, well it is in fact required. For those of you who went through the process, how to i proceed? How do I submit a statement? I send my birth certificate and a ''statutory declaration of my present marital status and indicate the name and citizenship of my future spouse''? So I just type that information down, sign it and mail it? I tried getting information through the embassy but it wasnt clear at all. Thanks.

Hello!

I got married this passed July to my husband in the Netherlands and was required to get a "marriage search" done by the Registrar of Ontario. You could always contact the embassy of the country you are getting married in to confirm what you need in order to be married in that country. I contacted the Dutch Embassy in Ottawa to be sure I had all the necessary papers and the statement in Lieu was only necessary if I couldn't obtain a marriage search.

I had originally sent in a declaration as well, and it was returned to me saying it wasn't sufficient and that I needed to have the marriage search done.

You need to go to a notary and make a statutory declaration on your current marital status, the name of your future wife and her citizenship. Price for statutory declaration varies, so look around for the best deal. Also contact the embassy to confirm if any other paperwork needs to be done. For example, I had to have a physical examination to prove that I am free of diseases and mental illness. Send in your papers to JLAC and prepare to wait about 2 months to get it back.

Also confirm with your embassy to see if the papers need to be legalized (offically translated to the foreign language), the embassy should provide that service if it is required.

To obtain a Statement-in-Lieu I don't believe I had to pay anything to DFAIT (Department of Foreign Affairs and International Trade). However, I had to pay the notary fees to certify the copy of my birth certificate and for him to draft a statutory declaration of my marital status (he charged me about $50). I then had to get the documents legalized by the consulate of the country where I was getting married (and they charge a fee for this too.)
