Spouses Open work permit and flagpole under implied status

Hi Guys,

i am really hoping somebody in this forum might be able to clarify somethings for me.

I am currently on a 3 years pgwp and working on noc B job for 2 years. My spouses is currently in Canada studying and will be graduating this month. She is currently on an implied status, waiting a decision on her study permit extension and we applied before her old study permit expired. She is not eligible for pgwp due to study gaps. We are planning to apply for Sowp for her based on my pgwp. But i notice one of the requirement is “Work in noc o,a, or b and approve to work in Canada 6 months or longer”. My pgwp will only be valid for 5 more months by the time we apply for her sowp( my pgwp was approve for 3 years).

so my question

1.Am i still eligible to get her sowp eventhough my pgwp is valid less than 6 months?

2. can we flagpole for her sowp with implied status?

1. As you only have 5 months validity, if the officer notices, she would be refused.
