Hi, Here is possibly a weird one. Spouse was sponsored from Nicaragua, left THE SAME DAY, she arrived in Canada. Made complaint to CIC. They cant tell me anything "Privacy Act" So I don't know if they followed up. I had no idea of her whereabouts. So.. glutton for punishment, I divorced her, and married another Nica lady. We have a child together, and I want to sponsor her. Now, my ex-wife has been spotted here in Managua!! She would only be here if deported. So my question is, if the sponsored person is removed from Canada, does the 3 year "wait period" still apply? Or can I sponsor my new wife now? And how can I get CIC to tell me?

When did you divorce? You are responsible for her for 3 years from the day she landed in Canada..Im in the same situation...am sponsering my 2nd spouse

3 year wait period is only for repaying social assistance that she might have acquired while in Canada. If she's been deported already, and she hasn't taken any assistance in the past 3 years, then you're in the clear.

If she does take any assistance from the govt, you have to repay it otherwise your 2nd application will be refused.

You're free to sponsor the 2nd wife, however be warned that your app will likely face scrutiny due to this being your 2nd sponsorship from the same country. If you explain to them how your first wife left you so quickly and you now have a kid with the 2nd wife, you should do fine.

Also I don't want to risk my $800 or so, to be turned down, unless Im sure she is outta there!! We only have until next May to wait otherwise

The fact that she has been seen in Nicaragua doesn't mean that her PR status has been revoked. As IRCC has already told you, they can't share her information with you because of privacy rules.

The only way I can see for you to really find out now is to just submit an app to sponsor your new wife. If your ex is still a PR, you will be found ineligible as a sponsor and the app will be returned. At that point, only the $75 Sponsor fee would be kept. If your ex has had her PR status revoked, then presumably IRCC will process the app as normal.

What is this mandatory 6 months in Canada? Are you a PR or a Canadian citizen? If you are a PR you must return to Canada to apply.

Probably referring to the time required to be in Canada in order to meet the residency requirement for provincial healthcare.

CIC will not tell you about your ex-spouses specific case, so what you should ask them instead is if you currently have any undertakings in effect. If they revoked her PR status then your undertaking would have ended and you can sponsor someone new. If they did not revoke her PR status your undertaking would have continue so you must wait for 3 years from when she landed to sponsor someone new.

I'm sure there is some way to find out your own undertaking situation.

Of course as a PR, you will need to live in Canada to sponsor your new wife and child and stay here during the processing.

Hi, just to clarify, I am a Canadian citizen, retired early, I need my 6 months for healthcare, as well as tax reasons. I do like the suggestion to call ands see if I have any undertakings. Will tell you how it went.

Im on my 2nd time around...our application passed SA..thats where they will check if you are responsible for any social assistance...and clear you or not...so they will run the exs name...if not they will return your app and fees

Be prepared to go through a rough time with Cic..they red flagged us due to my ex...refused us...we have now reapplied

I am sorry but this is the weirdest thing I heard. My heart is with you. Do you know if your sponsorship was conditional? If it is, then if you split within 2 years of her arrival, by law, her permanent residence should be revoked. I suggest you consult an immigration lawyer. There are lawyers offering free service at the immigration centre. You just have to visit your local immigration centre and ask for one.
