Spouse Visa or TRV visa?

Hi,

I am an Indian citizen who came to Montreal on a 1 year work permit and 1 year visa in October 2009. I got married in May, 2010.

Since I didn't know that Canada visa is tough to get, I sent a Letter of Invitation to my fiance in April before marriage and she applied for TRV for 30 days. Her visa was refused on several grounds

i) purpose of visit
ii) relationship status
iii) travel history
iv) financial status

We got married in May and we applied for her TRV again for 30 days. My wife is doing her PhD; so she showed NOC from her University, we put marriage certificate and phone records, and we showed her bank accounts with property of her father also. This time also her visa got refused on fewer grounds:

That the immigration officer is not satified that she will return at the end of her stay and also her financial status is not good. We didnt understand but we didnt try again.

Now I have extended my Work Permit for another 2 years. I am going to India in January and will be applying for my visa. I am thinking to put my wife's name in my application itself. Please advise. Should we apply for spouse dependent visa or a simple TRV for 30 days? The visa office has already her records and she is still doing her PhD. I presume we need to address the earlier two refusals.

Please give advice as we dont want another refusal this time.

What is your NOC code?

To be eligible for an Open Work Permit, the spouse or common-law partner of a foreign temporary worker must demonstrate that:

* the principal temporary foreign worker has work in Canada that is at a management level or a job in a professional occupation or as a technical or skilled tradesperson. In other words the skill level of the principal temporary foreign worker’s job must be level 0, A or B according to the National Occupational Classification (NOC).
* This skill level requirement does not apply to principal temporary foreign workers who have been nominated for permanent residence by a province (provincial nominees).

* the principal temporary foreign worker is permitted to work in Canada for a period of at least six months.

Hi,

My NOC code is 4122. I am sure my wife is eligible for open work permit.

My query was...should we apply her visa as TRV for 30 days or she applies as a dependent visa for as long as my work permit is?

Any suggestions,

Hi,

Considering that her visitor visa has been refused twice it would be prudent to apply for an open work permit (your NOC code being skill level A).
