Hi
Applying for a spouse visa with my boyfriend soon. We will be living together the whole year, but was wondering how many weeks apart are
ok? Going on a trip and I was looking to go back a few weeks earlier then him...

Also, we are living and working in Nz and I am getting paid cash in hand. Will this be a problem when they need to see
bank details in the application? Or are they just happy to see that you have enough money?

Thanks
Jenn

A common-law couple has to live one continuous year together. Short trips away from each other are OK, but there is no definition of how long these times away can be. It seems that two weeks would be OK, for example, but six weeks would not be. The risk becomes higher the longer the absence is.

It does have to be one year, for sure. So a two-week break in the middle of that year would most likely be fine. But do not have the break at the end - i.e., do not go home early. For example, if a couple is planning to use their stay together from January 1, 2015, to January 1, 2016, to establish common-law status, a short break in October, say, would be fine. But if one partner goes home December 20, 2016, and does not come back, that will not be seen as one year together.

Great thanks for that!
Annoying that there are no specific "rules" around that,
but Ill aim for 2-3 weeks apart then! Its in January-feb and the year
starts in July so should be fine.
