Spouse Sponsorship - USA and India

Dear folks,

I am planning to sponsor my fiance who is currently living in the U.S. She is an Indian citizen and is going to move back to India in a month after our wedding due to work reasons. I am going to sponsor her as my spouse after our wedding.

I had a few questions related to this and would really appreciate your help.

1. We are planning to get Police Clearance Certificates/ Medical Examinations done before our wedding and file our papers immediatly after our wedding. Is that ok?

2. My fiance and very soon to be spouse will be India when the application processing actually begins and she may not come back to the US. Should we provide New Delhi as our location for processing?

3. Our Wedding is going to be in the US and all our wedding, Medical exams etc., will all be based in the U.S. What issues do you foresee if we file the petition through New Delhi?

1. Yes, that's fine. Be advised though that both have an expiration date - the medical exam is only valid for one year and the police check should be submitted within 3 months of being issued. So try to get them as late as possible.

2. Yes, New Delhi would be advisable. They usually process very quickly. India has a thing about passports though, they will not send them outside the country. So whatever you do, don't have her send in her passport while she's still in the US. She'll have a hard time getting it back.

3. When you do the medical exam, be sure to tell the DMP you will be applying through New Delhi. They should send the results there instead of Ottawa, where they would normally send them if the processing was done in Buffalo. 1. Yes, it's Ok. Although, as per new process, you can't get medical exams done before hand.
2. Her application will be processed at NDVO (by default) since she has an Indian passport. (If she is also a US PR, they may select Ottawa). You don't have a say in that.
3. No issues with that. It may be cheaper to get medical exams done in Canada or India.
