Spouse Sponsorship-confuse 3 year undertaking

Hello members,

I sponsored my ex-husband in 2012, he landed in Toronto someday in November 2012 and returned to his home country right away, but he didn't get the PR card (due to PR card photo problem). I don't know if he ever applied PR card again in the past few years. According to CIC website:

"•signed an undertaking for a previous spouse or common-law partner and three years have not elapsed since he or she became a permanent resident"

if my ex never obtain a PR card, does he considered as 'became a PR'?????

Am I clear to sponsor my current husband now?

Yes, because the PR Card is not needed to prove his status.

Since he landed and became a Permanent Resident, he still is a PR, even without the actual card.

Now...if he has not been in Canada, he is still a PR but would probably lose his status (eventually) for not meeting the Residency Obligation.


Since it's been more than 3 years, you should be ok to sponsor your current husband. It's possible that CIC will question your new marriage, but it's nothing to worry about.

If he landed - then he became a PR. If he became a PR in November 2012 - then three years have passed and you should be clear to sponsor your new husband. The only thing that might prevent you from sponsoring your new husband is if your old husband went on welfare/social assistance during the three years after he landed in Canada.
