Spouse Sponsor - UK Police Certificate, Train Fare Fine

Hi All,

Just had a quick question regarding an entry on my wife’s U.K. acro police certificate. Basically, 8 years ago my wife was unable to pay a train fare and was written up for it. Fine letters were sent to her parents address where , 6 months after the event, she no longer lived. She never received repeated fine letters and was summoned to a magistrates court. My wife eventually did receive a copy of the letter and settled the total fine (£160) out of court towards the end of 2011. This fine/offence is now on her record and police certificate until 2023.

I just wanted to know if anyone had encountered issues like this when sponsoring before and whether the best thing to do is for us to simply write a statement explaining the events? I suppose my somewhat irrational fear is that this will be a big negative to our application?

Yes, she needs to explain it but it is not a reason for refusal. Does she still have the court documents?

Explain this and attach all the court documentation that you have that shows she paid the fine. This is a minor penalty, and will not cause too much of an issue. As far as I'm aware,not paying train fare is not a crime under Federal law in Canada, so you don't need to apply for Criminal Rehabilitation.

Thanks for the reply!

My wife was able to settle this out of court and therefore we don’t have much in the way of documentation/ court documents. We are trying to find the bank statements showing the fine was paid, but because the event was greater than 7 years the bank are having to find copies as they were archived due to data protection etc.

So I think best thing for us to do is explain the event, make reference to the police certificate listing the fines and try to provide bank statements showing fine paid when we get them and hope for the best. As you have stated above, this doesn’t sound like too big of an issue which is good!
