Spouse Sponsor and Working Holiday Visa

My wife and I are currently living in Spain. We got married a year ago and we are cosidering to move back to Canada.

I got recently a working holiday visa that allows me to work for a year in Canada since the time I get there.

We want to apply outland this month and we don't know if there is any problem on using the whv to go to Canada before we get the PR.

Any help would be appreciate,

Is your wife a Canadian citizen or PR?

Ok so your wife is a Cdn citizen, you are both currently residing in Spain and you have a working holiday visa that will allow you one year to work in Canada correct? You mentioned applying outland. Is that faster than inland or do you just want to assure a process of appeal option if you get refused? I wish I could help more but I am going to ask some of the more experienced members to comment as well.

It seems to me (make sure you do a bit more research online first though, maybe even do one consult with an immigration lawyer) that you could both enter Canada and simply apply inland once you are both here together. Especially if you can get an extension of your working holiday visa. Many of us do not have the option of being with our spouse as we wait for the PR so that is always the best scenario if you can get it. Anyways I just found a link on this forum with a few people in your exact situation so check it out. Remember to check the dates so the info is not too old.

Jp, you don't say your own citizenship, are you Spanish? I ask to determine what visa office you would use outland. If you are Spanish, it is the Paris office, total outland processing time right now is 10 months. If you're not Spanish but have been legally admitted to Spain for at least a year, you can apply through Paris or through your own country's office.

Apply outland, come to Canada on the working holiday visa and your PR app will (unless you have a massively complicated case) be approved before your WHV expires.

There isn't an issue with entering Canada on the WHV while you have a PR app in process. If they even ask you anything at the border, just make it clear at the border that you aren't moving to Canada permanently (so don't bring all your stuff :)) and that you understand if the PR is denied, you must leave at the end of your WHV.

Thanks guys,

Sorry for not mentioning my nationality, I am Spaniard.

That's exactly what we needed to know, if there was any conflict with applying for the PR outland, going to Canada and using the WHV while the PR is processed.


I absolutely understand the rules and don't want to break them so there shouldn't be any problem with the border officers.
