Hi people,
I am applying for my spouse PR and had a question. Would be appreciated if you can answer my situation.
So I’m PR and living in ontario. My spouse is on study permit and living in alberta currently because of her university. We got married in july in canada but not started living together yet. I’m applying for her sponser PR but dont know which category should i apply for.
Canada class? Which says that i must live with my partner, but we are not living together yet.

also, her study permit is expiring in march,2022. So if we apply for her sponser application and by the time her PR application is still in process, what should we do? Apply for work permit or anything?

Since you are not living together, you must apply through the outland (outside of Canada) route. You cannot apply inland (within Canada). You must be living together in order to apply inland.

Since you will be applying outland, your wife will not qualify for a work permit through spousal sponsorship.

If she completes her studies by the time her study permit is expiring in March 2022, then she should apply for a PGWP. If she does not complete her studies by then, she needs to apply to extend her study permit.

Can I apply inland with referense letter explaining my situation?
my spouse has semesters going on in alberta university until April 2022, once she graduates, she is gonna come live with me in Ontario.
can I explain this situation in letter with InLand application or there are chances of rejection?

No. A mandatory requirement of the inland process is that you be physically living together.

Your options are to apply outland now. Or wait until April 2022 and apply inland.

Agree. You need to fit the live together requirement when you apply. (and contiue to live with your spouse)

You may need to look into extending her study permit if study permit is expiring in March 2022 and her classes are going on until April 2022.
After that, can't she apply for PGWP?

Yes, because of covid situation earlier in 2020 her study was extended, so she will apply for extension and after that she is eligible to get PGWP.
So I guess, I'm gonna go with family class process for now, and then will look out for her extension and PGWP.

Hi, I understand this is a really old forum but I need urgent help.
My spouse’s came to Canada on a study permit, after graduating got his work permit for three years. He misread the expiry date on the work permit and his visa is expiring by end of this month. I’m a Permanent resident and we are applying for his online Inland spouse Sponsorship before his work permit expires.
However, due to COVID we are not sure if we’d be able to get first stage approval ( Sponsorship approval) on time or not which is required to extend his work permit.

This discussion isnt' that old.. OP posted on Oct 2021... So it's only a few months ago....

COVID or not, nothing get approved within a month.
 
I know it won’t get approved within a month. However, we can work on a implied status. I’m just asking is there any way to apply for extension of work permit along with inland spouse PR application

Already answered in your other thread. You have to mail in your application for this to be possible. Not possible if you apply online.
