Dear forum members,

I applied under CEC in October and was expecting my medical request within the next couple of days. Unfortunately I received an email requesting following documents for my wife:

Ø Police Certificate: Provide an original police clearance certificate from Austria. For more information, please consult the following website: http://www.cic.gc.ca/english/information/security/police-cert/europe/austria.asp. This must be received at this office by: 2014/06/23

Ø RCMP Criminal Record Check: Provide a certified criminal record check. For more information, please consult the following website: http://www.rcmp-grc.gc.ca/cr-cj/fing-empr2-eng.htm. This must be received at this office by: 2014/06/23

- When we applied for the permanent residency in October the original Police certificate from Austria for her was provided.
- Also, I had no idea that we have to supply the RCMP Criminal Record Check!?!?

Additional Info:
I'm currently working in Canada with a BOWP and my wife is in Austria. I'm the principal applicant for the application. She is currently in Austria, but was living in Canada for a total of 1 year within the last 2 years.

The questions:
- Can we (does it make sense to) challenge that request?
- We have to supply the documents within 60 days, but the RCMP check itself takes 22 weeks according to their website. (She will have to apply for it from Austria) How could we speed up that process or increase the 60 day limit?

Maybe it was older than three months at the time you submitted it?

- Also, I had no idea that we have to supply the RCMP Criminal Record Check!?!?

You do not have to submit a RCMP CRC with your application, but CIC will request it if a name based search comes back positive.

Instead of trying to do any funny business, I would get busy gathering the requested documents within the given time.

- We have to supply the documents within 60 days, but the RCMP check itself takes 22 weeks according to their website. (She will have to apply for it from Austria) How could we speed up that process or increase the 60 day limit?

Again, instead of looking for ways to speed it up or anything, I would get on it right away and if you know there won't
be enough time to submit the documents withing the you given time, email CIC and ask for an extension.

For your above question, if we go through fingerprinting agencies, then you can get rcmp check within 9 working days(Not 22 weeks). But you have to pay around 50 dollars.

The below information from the website shows for you:

Electronic fingerprint submissions to the RCMP is not currently available outside of Canada. You may contact accredited companies within Canada who will digitize ink fingerprints and submit them electronically to the RCMP.

I don't know why the Austrian police certificate was asked as it was provided, but if your wife stayed in Canada for over 12 month (Doesn't matter where she is now), a RCMP check is required. Some say CIC has access to RCMP database, but on the safe side you should have provided that along with your application. So I would suggest you not argue against the RCMP request, but try to get it in 60 days.
 
This is very good info. My wife and I did the RCMP request through a fingerprinting agency that submits electronically and we got it in a couple of weeks. We did it inside Canada, though. It looks like the OP's wife has to fingerprint in Austria and somehow submit electronically to RCMP...

You can argue and maybe win (maybe it was an oversight), but we don't know if there was a problem with the one submitted or not. if it is easy to get (as I suspect it is in Austria), just do it.

It is not required as part of the application. CIC automatically conducts name-based RCMP checks for all applicants. They only request finger-print based checks if the name check is not clear (i.e. someone with the same name as your wife has a criminal record). Then, a fingerprint check is needed.

Individuals outside of Canada get the prints done on paper, send to one of the approved agencies, who scan them, convert to digital prints, and then submit it for you to the RCMP... this is MUCH MUCH faster....

I'm not trying to take any shortcuts here, I was simply surprised that some of the requested documents have been provided already.

The provided documents have not been older then 3 month, got them a week before we applied.
