spouse open work permit

hello everyone,
I have a simple question, Appreciate I could get a precise answer

I am having work permit issued in Singapore by Canadian high commision here, it has 2 years validity till june 2013,

When I was granted this wp, i was single, but now I am married- although I never traveled to canada yet as my company had given different assignments here as well in europe also i was busy with my marriage / honey moon etc.

now i want to apply for my wife's open work permit, she is recent graduate from top ranking college - kindly help figure out the best path to get it

Should I apply via online or paper dox at the high commision in singapore - what forms should i use.

If she graduated from Canadian University, apply Post-graduate Open WP. If not, only when she accompanying you to Canada, she can apply for OWP if your occupation classification is skilled or under any pilot projects.
Both needs form of applying for WP from outside of Canada. Marriage certificate copy is required.

Many thanks for your reply.

Should I just submit form1295 with a marriage cert. and nothing else??? Or you think its a good idea to have my employer write in a good intro letter for her and attach with the application, what do you say??? also what about bank statement, is it necessary to attach a recent bank statement or not??? Please advise.

Thanks for your reply. My work permit is valid til june 2013 whereas it says on the website that I need to have 6 month validity of workpermit to apply for spouse. Even though my workpermit was issued for 2 years validity.

I have two questions now, should I just apply for spousal work permit or should I apply for my renewal of work permit together with my spouse open workpermit. Please advise.

I would go for renewal together with new application for spousal. As anyway her WP could not go beyond your WP validity. If you urgently need to get her WP, then its ur decisoion to get a short one and extend later.

My employer is going to give me permanent employment at our canadian branch, and my existing WP is expiring in June '13 -

* Should I apply for extension now together with my wife's OWP
* or should I just apply for her OWP (she will only get OWP valid, til my validity)

considering my existing WP is valid til june '13 and I read on the CIC website that the WP should be valid for atleast six month to apply for spousal OWP???

I am confused what to do????

I also read somewhere you can not apply for extension sooner than 2 weeks of expiration of your existing work permit,
I am totally confused here, my work permit is still valid for six months !!! Please help

From what you've written, you've never used/activated your work permit. So there's nothing for you to extend, and therefore no way your spouse can get an OWP.

Your current work permit, though never used, is still valid till June 2013. So technically you could attempt to use it - i.e., obtain a TRV, travel to Canada, and get the work permit officially issued at the port of entry. However, given that 1.5 years has passed since it was issued and only 6 months are left, you will likely have trouble convincing the border officer to grant the work permit and allow you in. The officer will question whether the job is actually still available, why you waited so long to arrive, whether it's likely you will leave at the expiration of the work permit, whether Canadians would now be available for this type of job were the employer to re-advertise, etc.

First you have to get past all the above issues - only then, if you're successful, can you think about a WP extension. As to whether your wife can get an OWP, again I would say you have to resolve your own primary hurdles, then think about the OWP.

By the way, was an LMO obtained before the work permit was was applied for the first time?

Maybe others can weigh in as well if they agree or disagree with this viewpoint.

Many thanks for your reply to my query,

I have been given this work permit for a highly paid job, (I work for this big multinational company on a executive position). I was involved into a high level project at Europe therefore I was not able to go to Canada (all assigned my by company), also Like i mentioned earlier, meanwhile I also gotten married was on my honey moon to Europe :p

I am LMO exempt category, and the position can not be filled in by any local Canadian due to certain nature of my job,

Now, my question remains, should I re-apply for work permit including my wife in the application or should I apply just for her OWP?

Please suggest what you think is best way - Many thanks.
