Thanks very much. We have been married for 4 years with years with three children.

I may have to wait until her first semester is over but she wants me to try in January lol lol. But excellent points.

Hi Everyone,

Did anybody here reapply for SOWP and made a response letter to the refusal? We just got rejected last week (outside canada) and planning to reapply our application hopefully in the next few weeks. My fiance just got his medical last August and I believed it is valid for one year?
Should he do another medical or the one that he sent with his previous application is still okay?

Hope somebody can post their sample letter of response to refusal. It will be a great help.

Hi Cali,

Your spouse is entitled to apply for SOWP if you have the PNP certificate as stated in the Foreign Worker Manual Section 5.38 R205 (c) ] Pages 81-82 LMIA exemption code T13, NOC level does not matter if you are a nominee.

I have applied 3rd time for my wife with same medicals which took in April.Last application was submitted on 7th Sept with same medicals and got approved on 6th Nov.

Hello Everyone,

Here is my situation, i have WP working under NOC A and my wife is here in canda with me but with a visitor visa.

- Which is the shortest way to get for her a OWP?
I want to know if is possible to plagpole for her OPW, were are not visa exempt but she has a visitor visa.

She is going back home for Christmas. Can she apply by herself with all the documents at the airport on her way back to Canada?

I'm making these questions because i want to avoid the processing time that take online application because her TRV expire on march.

i will really appreciate your help.

I don't know, at any rate they would treat this as a mistake nothing more in my opinion.

However, if you already didn't have a file number along (they might use name, DOB and passport number) to identify the applicant. So its possible to have lost it because of invalid info.

You should send an email / case specific inquiry with correction.

You possibly can, but there is some element of risk too since she primarily is not from a visa exempt country.

Technically since she has trv, it might work fine, but officer would ask why are you not applying to CIC internally. The processing time is 120ish days so Mar is still quite far.

At the end it depends upon the individual CBSA officer. In the very worst case (though very very unlikely) she can be denied entry.

In practice at max he would say that i am not satisfied that you had the need to apply at border. Please apply in land and would let her in as a visitor.

A more convincing argument is the situation when you have to actually join a new job or something which makes more sense and is usually for principal applicant, rather than a dependent.

As much as i know since you already have a work permit and she would probably carry a copy of it along with proof of relationship, she can surely do that on her own. There is no requirement for principal applicant to be along though i don't know if for CBSA it look more credible if the principal applicant is along. This is just opinion. On paper there is no such requirement so she is good on her own.
