Hello everyone, I am currently a student on my study permit who has taken a Pgdp course and its a two year course, my course is ends in December 2024, so my question would be am I eligible to apply for open spousal work permit once i go into my work permit, since the immigration minister had a new announcement of only masters and Doctoral programme students can alone apply for Open spousal work permit, but after december i will be on my work permit, is that eligible to apply for OSWP?

Once you have a job and 3 pay stubs your spouse should qualify for SOWP when you have a PGWP or you have applied for a PGWP. The only other potential issue is if you have minimal in person relationship history and you have applied to the SOWP soon after getting married there are sometimes concern about the validity of the marriage and that the marriage could be based on immigration. It does sound like that there will be a period between when you got married and when you apply for SOWP which will be helpful. Hopefully during this period of time you will have visited your spouse in person. If you haven’t visited in person if possible visit during the SOWP processing period and update your application via webform that you have visited your spouse either in Canada, in your home country or in a 3rd country.
