Spouse Open Work Permit Process Details

Hi All,

My spouse has got a job offer in Canada (NOC - A). He is planning to apply for work Permit while reaching Canada at the port of entry. Based on this, he wants to apply for my visa (TRV/OWP). I am also currently working in India under NOC - A category job.

I have couple of questions:

  • Can he apply for my OWP while applying for his work visa?
  • What is the difference between Dependent visa and TRV?
  • Do I need to apply for my open work permit from India? If so, how to proceed and what documents will be needed? Processing duration?

Is your spouse also from India? If so, he cannot apply for a work permit at the POE. http://www.cic.gc.ca/english/resources/tools/temp/work/port.asp

Has the employer in Canada already obtained a positive LMIA?

Hi Canuck,

Yes. He is from India.
My spouse's work permit is being taken care by Company's legal team. It is expected that he will get work permit by 1st week of August. However, My visa and permit needs to be processed by myself.

Based on this, can you advice me on my situation?

Hi Rinki,

Your husband can apply for your OWP at the same time as his work permit. I do not understand your comment about him applying for WP at Canadian POE. Is he a citizen of a visa exempt country or a US GC holder?

Since both your applications are of the same type i.e. work permit, you should both be able to get a response within the same timeframe.

'TRV only' is when you'd apply to join your spouse to reside (and not work) in Canada for the duration of their work permit. However, if you are not from a visa exempt country, your open work permit application will automatically include the TRV application since you need the TRV to enter Canada.

Hi Sir,

As per Company's legal team, we can not apply same time. Let's assume once he gets his work permit, I will apply for my OWP.

Can you advice on how to go ahead in this situation?

Hi,

In that case, you may apply for your OWP After your husband has successfully obtained his work permit.

You may apply online or through one of the VFS centers. The links in my previous post still apply.

I recommend that you start putting together your paperwork right away so that you can file on the day your husband's permit is approved. Please prepare a letter to the Visa Office and include in your application. The letter should talk about the duration of your marriage, your ties to home country (property, job etc.) and the need for you to be with your husband in Canada.
