Spouse open work permit got refused

Hello everyone, I got spouse open work permit refused and IRCC says:
“After considering all the circumstances of your case, it has been determined that you are not a person whose employment will create or maintain significant employment, benefits or opportunities for Canadians citizens or permanent residents. Eligibility for a work permit in this category only applies to the spouse or common-law partner of a work permit holder. You have not established that you are the spouse or that you meet the definition of common-law partner, as defined in the Immigration and Refugee Protection Regulations.

Please note: The onus is on you to provide sufficient documentary evidence/proof that you have been cohabiting together for over a year, and are in a genuine relationship.”


i don’t understand the reason “not a person whose employment will create or maintain significant employment, benefits or opportunities for Canadians citizens or permanent residents.” because both me and my spouse all have Teer 1 full-time job

Also, what else should we provide them to prove our genuine relationship? (we submitted Joint bank account, rental lease, Bank statement with same address > 1 year, ID with same address > 1 year)

We are trying to prove Common-Law and I extend my work permit according to my spouse’s work permit.

So you have lived continiously together for 12 months, and ALL your statements prove that? Joint bank account a year old? When did you become common law (dates from when you become common law)? When did you both enter Canada? What is your status now? What is partner’s status/type of work permit/expiry? You having a TEER 1 job is not relevant but what are your NOCs?

See you became common law on December 31, 2023 if starting living together on January 1. Assume you notified IRCC and filed taxes as common law with CRA. Show CRA documentation.

Yes - We live continously from 2023-01-01 until now (I only attached few bank statements, do I need to re-submit ALL bank statements from 2023-01 until now?)

They not prove my common-law relationship, but 2024-01-01 is the date we lived > 1 year together

Joint bank account > 1 year old - Yes

My spouse entered Canada 2022-01-01, I entered Canada 2022-12-15, then we moved together since 2023-01-01

My status: PGWP until 2025-04, my spouse status: PGWP until 2027-01. We want to extend my work permit to my spouse’s

my spouse: NOC 21223
My NOC: 11202

Please advise if you can help! Thank you so much

Yes we became common-law on Dec 31, 2023 since starting living together on Jan 1, 2023

Yes - We filled taxed for 2023 as Common-law but how can I notify IRCC about that?
I didn’t submit CRA documentation
