Hello everyone, I got spouse open work permit refused and IRCC says:
“After considering all the circumstances of your case, it has been determined that you are not a person whose employment will create or maintain significant employment, benefits or opportunities for Canadians citizens or permanent residents. Eligibility for a work permit in this category only applies to the spouse or common-law partner of a work permit holder. You have not established that you are the spouse or that you meet the definition of common-law partner, as defined in the Immigration and Refugee Protection Regulations.

Please note: The onus is on you to provide sufficient documentary evidence/proof that you have been cohabiting together for over a year, and are in a genuine relationship.”


i don’t understand the reason “not a person whose employment will create or maintain significant employment, benefits or opportunities for Canadians citizens or permanent residents.” because both me and my spouse all have Teer 1 full-time job

Also, what else should we provide them to prove our genuine relationship? (we submitted Joint bank account, rental lease, Bank statement with same address > 1 year, ID with same address > 1 year)

Posting under Family Sponsorship so if PR is under process then posting under right section. If not, post under foreign workers and include what permits your spouse and you have. If spouse is on PGWP/closed work permit then include NOC, date of expiry. When did you become common law after living together for one year continiously.

Are you are PR or citizen of Canada? If not, you have posted in the wrong section. OWP can be applied for spouse being sponsor by PR or citizen once the sponsorship application have reached AOR.
If you are not a PR/citizen sponsoring your spouse to become PR, you have posted in the wrong section of the forum.

Hi, we started living together since 2023-01-01 and 2024-01-01 is one year. We applied for spouse open work permit on Sep 2024 and got refused today

If one of you is not a PR and you have not applied for PR status under spousal sponsorship for the other - wrong forum.

If those conditions are true, probalby applied under the wrong spousal open work permit program.
