Spouse and open work permit and Permanent residency Help please!!

Hi,

I am a Canadian born citizen.

1.5 year ago i was working in Turks & Caicos in a resort as a Bartender, i met this girl who worked there too and we fell in love. Now my contract is over and i am back in Canada, me and my Girlfriend are trying to start building a life together. We are not yet married, but it is a possibility if it makes things move forward faster. thing is i want to go back to university, cant be a bartender forever, and as much as id like going to live with her in California. school is WAY too expensive in the us. I would like her to come with me to Canada while i study in the very least.

She does not qualify for skilled worker visa sadly. She is a restaurant manager and she would need an open work permit to my knowledge.
Like i said i want to go back to school and i cannot support a person at the same time, so she would need to be able to work here when she get here.

She is in the states now and we have been trying to figure out a way to make it work for the longest time but everything is so confusing and complicated it makes us hopeless. Like if in all these files and visa and document, there is not a single thing for a situation like ours.

I love her and i get so anxious that everything will fall apart due to some bureaucratic wanking. Not only that but i keep delaying my project because i cant move forward with them until this is resolved. I cant engage myself in a 4 year commitment to school, time flies and i am stuck running in circle trying to find a solution.

I need someone who understand visa application and permanent residency to explain to me my option and the time delay and the right way to go about it. Or are we doomed and there is no way we can achieve what we want in the near future due to our financial situation?

She doesn't qualify for an open work permit at this time. To work in Canada now, she would need a closed work permit. To get a closed work permit, she would have to find an employer who is willing to offer her a full time job in Canada and is also able to obtain an LMIA (approval to hire a foreign worker). This is quite a lengthy and significant undertaking for an employer (several months of processing time and a $1K fee).

If you are serious, then once you are either married for common law (have lived together for a minimum of a full year), you can sponsor her as your partner/spouse. Once her PR has been approved, she can come to Canada and work without a work permit. You could sponsor her from Turks and then plan to move back to Canada together once her PR status has been approved.

we are not in turks, she is in california right now...

ok lets say we marry, how long would it take before she gets her PR? and what course of action should we take from that day?

If you get married, you need to sponsor her for PR. In a few months or several, she will get her PR and can join you with the right to live and work in Canada. In the meantime, you can continue to visit each other.
