Spouse and NOC Questions for Express Entry

Hi,

I am working in Canada for the past 1+ year through Intra-company Transfer (ICT) work visa, having deputed from my base location in India to Canada. I have a couple of questions.

1. My NOC code as per present work permit is related to IT Architect. Though I started off as an Architect, I moved towards managerial role and currently working as an IT Manager where a couple of Architects are also there apart from Designers and Developers. As per my present role, I am choosing the NOC code related to IT Manager and got the work experience letter also from my present employer based on my current managerial role. Is it expected that my Canada PR NOC code should match with my current Work Permit NOC code or it is enough as long as it matches with my roles and responsibilities in the work experience letter?

2. My family consisting of my wife and son are in India still and they are not interested to come to Canada at this point and rather insisting me to be back to India only. In fact, we are almost separated (though not legal divorce) and my wife will not sign on any PR application now but I am hopeful that she may accept in future. I heard from a couple of friends that it's better to apply along with family or may cause some issue in future including revocation of PR etc. I am confused as my family is not cooperating at this point, though I want to apply now itself as I am 40+ years old and having some financial issues etc. Can I apply for me only though just mentioning the family details and in that case I think I should choose that my spouse is not accompanying me. Right?

Can any expert please help the above questions? Thanks.

1. PR noc needs to match reference letter roles and responsibilities.
2. this is tough, even if you mention as non accompanying they need medical tests as well. you need to prove you are seperated.

Thanks Navinball. So I understand that it's okay if the NOC codes of my current work permit and PR differ and they will check with employer reference letter's roles and responsibilities only.

Coming to my 2nd question, I think I need to consult an immigration lawyer if it's complicated. Anyway, thanks again.

Hi Raj,
- As per your experience letter you would have :
Current role as IT Manager - start date and job responsibilities.... This should be your current NOC. (0213 i reckon)?
Past role as IT architect - start date, end date and job responsibilities
you can mention the salary, # hours worked per week etc and benefits etc as a standard opening para of the letter.

- Since your spouse is not willing to move here at present... you should file the application and include in there that she and your son will not be accompanying you. Once they decide you can apply for there application via family sponsorship program.

Thanks Bimal. My employer had given only for the current role and I think I should ask to provide a new letter to include my previous role as well.

your transfer letter or the WP would be mentioning the previous NOC(i am just assuming here), so the case office may question why does your WP say a NOC different to the reference letter... this can be addressed through the reference letter which will provide details that you started as an IT architect but subsequently got promoted to IT Manager over a period of time. So both experiences will only strengthen your application and bring clarity to the case officer.

attach the letter of employment (work contract/offer letter), pay stubs(i had attached last 6 months), WP copy, Letter of Reference and T4, NoA(if you have one)(redact the SIN# from it)
