I have Canada PR and I want to sponsor my spouse and kid(7 months old). But currently I am in India and won't be able to travel without my kid . So is this possible to apply my spouse and kid by staying here. My company would be able to process their dependent visa only after having record of their sponsorship application in system. Kindly suggest if sponsorship application can be submitted by staying here(India).

It's not possible unfortunately. You must be living in Canada to submit the application to sponsor them.

Your spouse and child will need to apply for a TRV if they wish to travel with you to Canada.

There is no dependent visa. It is just a normal visitor visa.

I know its visitor visa but this is how it was addressed by my immigration HR team. Not sure what is the difference. They need atleast a copy of application of sponsorship submitted in the system in order to process my dependents visa. So was curious could I just start the process and travel with my spouse and kid and complete the sponsorship process by staying in Canada. I want to just enter canada along with my kid but visitor visa is a long process.

As said above, there is no such thing as a dependent visa. They would be applying for a normal TRV.

You cannot start the sponsorship process from outside of Canada. It is mandatory that you be in Canada to apply to sponsor your wife and child.

Again, if you want them to travel with you, they need to apply for a TRV.

Ohk.. but why was I said by the team that before they file for my dependent they need sponsorship app in system . If it’s normal TRV then having a sponsporship app is not required?

I have no idea. It sounds like they don't know what they are doing.

There is no requirement to have the sponsorship application submitted for them to apply for a TRV. The two are completely separate applications.

Note that there's of course no guarantee the TRVs will be approved.

Truthfully, if they have told you there is a dependent visa - then they don't know what they are doing. There is no such thing.

Need to cross check with them on this.. thanks for your info..

If they know what they are doing, they should also be aware that it is impossible for you to submit the sponsorship application while outside of Canada. This is basic knowledge.

I would suggest that you submit the TRV sponsorship applications as soon as you can. Processing times are very long now. You can do this yourself.

In which scenario TRVs wont get approved?

In which scenario TRVs wont get approved?

TRV are meant for individuals who want to visit Canada temporarily as tourists - not who are looking for a way to move to Canada sooner. When IRCC knows the individuals applying likely have an interest in remaining in Canada long term, it's harder to get approved. Generally speaking, it's harder to get a TRV approved when your spouse is a Canadian PR or citizen.

When you submit the TRV application, you'll want to show evidence of your wife's ties to her home country such as employment, property and assets. If she has previous travel to countries requiring visas such as the UK or US, include evidence of that as well.

Rough guess is that your wife and child have a 50/50 chance of being approved. If the TRVs are not approved, you will need to move to Canada ahead of them, apply to sponsor them for PR and then wait for their applications to be approved. They will be able to travel to Canada and come live with you once they have approval for the PR application.
