Hi friends,

I'm in the same boat as a lot of you people here.

Fiance is in India. I'm in Canada. Living in the west coast. A permanent resident. I'm planning to get married next year.

But...my fiance has a TRV. Her brother lives in Canada and invited her. Her brother lives on the east coast. She got a TRV early this year.

Now, I'm not sure how to proceed further.

Can I bring her with myself on the pretext of honeymoon right after our wedding? Can she get asked about her intentions to return?

I'm planning to bring her her and applying for an inland application with an open work permit.

Another question I had was....would she be able to travel without any issue on her TRV to Canada.

I plan to bring her to Canada right after marriage. Can she be turned back by the immigration officer at the airport on the context of having her husband here.

Alright, I'll reiterate my request.

Her brother applied for a TRV stating the purpose of her visit as to visit him. She got it this month.

We're planning to get married in March 2018. I want her to travel with me to Canada. I'm going to apply for an inland application immediately after she lands.

My concerns:
1. Can she be refused entry at the airport due to a mismatch between reason for visit in her application and her current circumstances.
2. Should I book a return ticket for her just in case?
3. What would be the safest option when she's asked the purpose of her travel.

You should always be honest with them, or you could compromise the sponsorship application entirely whenever you apply for it. She can be refused entry by the officer any time, it's completely up to the officer. Since there are indications that she wouldn't leave the country, given the fact that her husband is in Canada, she could get her entry denied at the airport. She probably wouldn't have trouble traveling to Canada if she lies to the immigration officer saying that she's just going to stay there with her brother, not her husband/fiancee, it's up to you two if you choose this path, I wouldn't recommend it myself. Pay no attention to the comment on this thread, it's too vague and very much misleading. You could apply inland, but it's not anywhere near to be that easy.

I don't think immigration refugees and citizenship Canada would find it correct if you lied to the immigration officer. Usually those tourists visas are only valid for 3 months of stay, and the application inland takes about a year. She could be in implied status if she applies to renew the visitor visa, that could work for you. She's got visa for 10 years. She can stay for 6 months at a stretch. I'm planning to apply for work permit and inland PR as soon as she lands.

I'm not gonna lie at immigration.

Would it be better if she goes to her brother. She doesn't have to lie. She can then join me later.

Her file will show the TRV so it will be very esay for immigration to figure out that the reason for her March visit is not to visit her brother even if she actually stays with him. Neglecting to mention your marriage is misrepresentation by omission. This could effect her approval for the work visa before sponsoring her PR. Could even effect her PR. If I were you I would notify CIC before she travels in March that her reason for trv has changed and that she wants to come with you to Canada after your marriage.

I agree to your point that her PR file can get jeopardized due to mismatch in the stated reason for the visit. I tried finding on CIC about how notifying them of a change in status but couldn't find any useful information.

Further, would it be good if she can visit Canada in let's say...September for a fortnight. This would imply that her original reason for visit has been fulfilled.

I can always go visit her and we can mention in the file that I proposed to her while she was visiting her brother in Canada.

What kind of visa is it single entry? multiple entry over the course of many years?

I would send in an email mentioning her trv file explaining that she will be marrying a Canadian PR in March 2018. Simple as that. I would keep a copy as proof that you have attempted to notify CIC about the change in her circumstances.

If she writes to CIC regarding change in circumstances, Does it carry the probability of getting her TRV cancelled?

I can run with a number of things:
1) She can visit her brother for a month in October and return back only to come back again in Feb.
2) While she's visiting, I can marry her. Again, this looks suspicious.

My only concern is getting her here ASAP after marriage and ensuring a smooth PR sponsorship process.

Not to be rude but your concern should be getting her the PR. Nothing may happen to her TRV it is up to the government.

I'm still seeking advice on alternatives in this situation.
