Spousal visa - Complicated situation - Need help!

Hi everyone,

I am putting together the application to bring my spouse to Canada and have some questions. Please can someone answer from your experience or experts can share their insights. I'd be deeply grateful for your help.

My wife and I got married 4 years ago. However due to my father's poor health, my wife and I have spent most part of the past 4 years taking care of him back home. I even had to leave my job and be with the family physically for over 2 years as my father's health turned down. I am the only child. Other than my wife and me, there's no one else to take care of him so we both decided to be around him and fully take care of his health.

Now that his health has stabilized and quite improved, I have come back to Canada few months ago. I just found a job and slowly getting back on track, professionally and financially. Finally, my wife and I are ready to put together our application.

The question I have is, how do I represent my case. Should I mention this whole situation in response to the Q. 3 (Part-C) in form 5532, where they ask "are you living together? If no, explain why not? If either of you are living with someone else, include their names and relationship in the explanation".

My wife is living with my father at our family house. Should I just mention this in reply to the above question? Or should I explain the full situation till date?

Can CIC question that why are we filing our application after 4 years of marriage? I am asking this as people have situations in life and we make decisions according to the situations. And I feel family is a top priority for almost everyone of us. My wife has never been to Canada. We decided to wait as we were clear that we are not going to leave father behind till his health is improved and he is able to travel with us to Canada. We have all the proof of his medical treatment.

Do you suggest putting all this information in the cover letter?

My father has 10 year tourist visa and we are also planning to apply for his super visa. Once my wife's application is approved, both she and my father will come together.

Answer the questions honestly. Explain the situation where it ask why your not living together. It won't matter that you waited 4 years to apply, especially since you were living together during the time. I never had to write a cover letter for our application are you required to do so now? If not,i wouldn't do one. It just gives the case worker more to do

Are you a citizen or a PR? Do you meet your RO? Have you been living in Canada for 2 years in the past 5 years from the day you applied to sponsor your wife? If you are a citizen that is different.

Your father will have to pass a medical to come to Canada. You would also likely need to show your recent NOA to show you meet LICO. His supervisa health insurance will likely not cover anything related to his past medical issues. You will have to plan to pay for any medical care he receives that will be due to preexisting issues. It also only treats acute situations so he would be expected to return to his home country once stabilized for further treatment. Some extra things for you to consider.
