Hey There,

Does anyone in here know if CIC normally reject spousal application before an interview? If so why? What are some of the questions do officers ask at the interview? Are applications finalized within the one year period if everythinggoes well

I'm assuming you're applying outland? What is your VO? Have you received sponsor approval? A lot of your questions are dependent on the Visa Office.

Spousal (married couples) sponsorship applications are not normally rejected before an interview unless there are extenuating circumstances, such as inadmissibility of the sponsored spouse due to criminal records, public health risk, etc. Interviews are usually called when the immigration officer wants more information or has questions/doubts about the genuineness of the relationship.

Most applications are processed within the timeframes for each particular VO listed on CIC's website (http://www.cic.gc.ca/english/information/times/perm-fc.asp)

Thanks for ur speedy response. My application i was an inland one. However, when we sent off our application I October I was out of status from May leading up to application date and we didn't use a consultant. We were wondering if this will have a negative look on the application. So inland style, what are some for the interview questions?

I know very little about the inland process, so hopefully someone else can help you. You are waiting for stage one approval, then? Your lack of legal status in Canada may be of issue because i don't think you would be considered to have implied status, but again, someone who knows about the inland process may be able to help.

For the inland process, there's a new public policy sometime ago that permits spouses who are out of status to apply for PR; maybe someone could add credence to this. So even if ur out of status before u apply, once the application reaches to Vegreville the applicant gets implied status. Buy I wonder if they'll abide by the policy or they could use my out of status against me

You can certainly apply inland when you are out of status. However there's a higher chance you will be called for an interview for Stage 1 and/or have your file transferred to the local office for further investigation. Long story short, it's quite possible you will experience longer processing times than normal.

Amikety, I didnt apply for an OWP at the time of the application. Ok if they need to call me in for an interview then it's all good with us. We just go and let them question both of us. My wife had told me to try and renew or extend my status but I took it for granted that my permit was expiring May and the application was gonna go in a few months later. Nonetheless, we sent them tonnes of evidence such as one year joint lease, bank account, insurance, letter from friends and families, cards posted to us etc. We didnt have much of evidence that other people had

Based on posts from another user - quoting CIC regulations - you must submit the Open Work Permit application to get Implied Status. Without this application, there is not Implied Status.

This is a hot topic - a misunderstood one as well. I was on the misunderstanding side until recently and only compelled to change views with viewing CIC's own policy. Others will probably tell you I am wrong. This is fine. As I have said, it is very misunderstood. You need the OWP for Implied Status. At this moment, you still are out of status.

At this point, you may want to apply for restoration of status or hope you aren't given a departure order. That last part is like playing with fire. You may not be given the order.... but is this something you wish to risk?

I sent in the application for a work permit last week because even though I don't have AIP I want to be sent the work permit when I get AIP. This will give me implied status

I really don't think you need to worry at all. CPC won't reject your application outright unless either of you are ineligible (i.e. if you commited some crimes or something). The out of status thing might count against you in determining whether you are genuine or not (I don't see why it would, but you never know..... complications are normally not a good thing) and could get you sent for an interview, but is certainly no ground for rejection.
