Spousal sponsorship with expired PR card

Good evening everyone,
Can my husband apply for outland spousal sponsorship if his PR card expired and he does not have yet 730 days of staying inside the country?
He got PR 5 years ago. Didn't live in the country but moved only 1 months ago before PR card expiration. He will stay inside the country for 730 days and then will apply for renewal. We are afraid that if we apply for sponsorship now, they will question his residency obligations and will revoke the status

He absolutely should not apply before back in compliance with residency obligation. The card expiry date itself is irrelevant though.
