Hello everyone. I am new to this forum. I will make a long story short. My husband is Mexican, I am a Canadian Citizen. Initially I moved to Cabo San Lucas Mexico to be with my husband. Things did not work out for us there and on Sept 14, 2014 Hurricane Odile ruined our lives. We moved to Mexico City, were we currently reside and are staying with his mom in her home, no rent. We moved here to have lesser cost wise place to stay while we apply for his PR residency to which I want to sponsor him.

I am from Regina, lived their almost my entire life except last 13 months lived in Mexico. I have hired an immigration attorney in Regina to assist us with his application. I currently do not work in Canada of course because I am in Mexico, have what is called a 2 year residency visa into Mexico. My husband works here in Mexico City at a car dealership, he just started a few weeks ago, as we just moved here on Oct 3, 2014.

My lawyer has informed me that due to me having no income I will need to get a cosigner for his PR application. I am not 100% sure on this. My reading on this states that there is no income requirement on a spousal sponsored visa and that the only person that can be a cosigner is a spouse and that would be regarding sponsored visa applications for family members other than a the spouse.

I read that a letter from a family member or friend stating that we can live their rent free until we get jobs would be the option in this case. Not sure what would need to be included. I do not have a cosigner as my mom is disabled and would not have enough income to do this. I have no other family to assist with a cosigner, so if I do need one and I cannot get a cosigner, I will have to leave my husband here in Mexico City and go back to Regina, find a job (I am a skilled worker) and than apply with my job/income info which leaving my husband and not seeing him for a year or more would be extremely painful to us both and harmful to our relationship as I am sure many of you would know.

Can anyone shed some light on cosigners for spousal sponsored visas? I am confused because I have a lawyer saying I should get one as I do not have a job in Canada.

Fire your lawyer immediately. If he / she said you need a cosigner for a spousal application, then they don't actually understand the sponsorship requirements and I would be very concerned what else they might completely mess up.

You are 100% correct. There is no financial requirement to sponsor a spouse. You just cannot be bankrupt or on social assistance (welfare). It is also impossible to have a cosigner on a spousal application. So your lawyer's advice is incredibly incorrect. Again, fire him / her now.
