Spousal sponsorship to Canada of a refused refugee claimant in australia

Hi

I am married to a refused refugee claimant in Australia.. His refugee case is now pending federal court hearing in Aussie. What is the best way to bring him to Canada .. he does not hold a passport and cannot get one. Can I sponsor Him under family class while he is in Aussie with an unknown refugee status ? Please help.

I assume his passport is being held by Australia pending the results of the federal court hearing.

A passport is a mandatory document that is required as part of the Canadian immigration process. I don't think you can apply until he has his passport again.
