Spousal Sponsorship ... i'm stuck!

Yes, I know there are lot of information available on this forum regarding the captioned subject but still I'm stuck... you may call it my ignorance!
Four years ago, my wife who was Canadian Resident sponsored my application while I was at origin country. Later, we moved to Middle east and informed CIC about the current status of my residency and so did the same for my wife that she is accompanying with me in middle east. It adds the fire to my case which resulted in rejection of my family spouse application. Reason was straightforward that PR resident cannot sponsor family while living outside Canada. It was all my fault!!

Later, i applied visit visa after 3 yrs and even after 2 months of processing, it was rejected because of reason that i have got strong family ties in Canada (my sister is also Canadian Citizen) and Counselor was afraid if i will not come back to Middle East, once i land to canada, although I'm earning a lot here!!! regardless....

Now, my wife is Canadian Citizen and i got a baby boy who also got the Canadian nationality. Now I want her to reapply again the family sponsorship application from outside Canadia i-e while she is living with me here in middle east. Yes i know if you are a Canadian citizen, you can sponsor your spouse without being in Canada but you do then have to prove that you are planning on moving to Canada when your spouse gets approved for permanent residency. My Questions are:

1- In above situation, can she still apply for my family spouse application while living with me in middle east?
2- Since application timelines for the processing is 2 yrs, can she keep living here in middle east or there is a need to send her back to canada off and on or once a year, etc?
2- Returning proof (arranged jobs, being accepted to college, having arranged housing or letters from friends & relatives stating that they know of your plans and that you can stay with them while you look for housing etc.) are required after my application get approved?
3- Any further recommendation which helps my case? Any guidance is appreciated...

1. Yes, she can.
2. Yes, she can remain there.
3. No, it is required in order for your application to be approved. In other words, if she does not submit the proof that she will return and re-settle in Canada, they will reject her again.
4. Make sure you not only submit proof that your wife is returning, but submit proof you are leaving, because they have no reason to suppose that if you are approved for PR that any of you actually want anything more than status in Canada and will not just pack up and head back to wherever you are now if they approve you. So make sure you have proof you are leaving your job, that your employer knows about it, that you are taking steps to establish yourself in Canada, because they will ask for it in order to approve your visa.

1- Do I have to submit the proves along with my sponsorship application at the very first beginning?
2- If yes, what could be the relevant proves since it is very hard to predict 2 year ahead of you, right? (e.g arranged job, college acceptance or having arranged housing?) Any solid and logical document that I could attach (other than the letter from my relatives that that they know of my plans)?
3- We are filing zero tax return for her since she is not doing any job, can she still sponsor me without any unforeseen issues from CIC?\


Should i leave reapplying visit visa again to Canada or there is any way though i've valid US visa ?

1. Your wife must submit proof of her resettlement plans with the application in order to be approved as your sponsor. The proof that you are actually going to settle in Canada can be less detailed than hers, but there should be some evidence you are actually planning to move. The visa office will ask you for some very specific documents when they are ready to issue your visa, things that I mentioned above. You will be required to prove that you have cancelled your residency in the Middle East, by the way.

2. In addition to letters from relatives showing you are settling in Canada, you can outline how you plan to manage your finances, organize your belongings to get them shipped if that is the case, plus any of the 3 things you mentioned that might be relevant.

3. Yes, she can sponsor you without income, she just cannot be receiving welfare or an undischarged bankrupt. You will need to show how you plan to provide for yourselves once in Canada, so if you have savings/investments, you can submit proof of those.
