Spousal sponsorship from Uk to Canada

Hi

I am a Canadian Citizen married to a UK citizen Living in England. we have been married for two years - married in Alberta. I just found out I can get my job back in Canada which will start Mid June. I don't want to be apart from my husband for very long and in turn he doen't want to be with out a job for too long.
According to the CIC processing time website
if we apply for an outland sponsorship stage 1 will take 28 days - -- question--- after Stage 1 can my husband join me in canada and apply for an open Visa and come work in Canada while stage 2 is still in progress? or does he need to be in the UK?

If we apply for an inland sponsorship: 1. if he travels with me (I have a guaranteed letter of employment) can he get an open work visa at the canadian border? CIC website "If you are authorized to work in Canada, your accompanying family members may also be able to work in this country by virtue of the permit you were issued. No other authorization is required. If they intend to work while in Canada, your accompanying family members should find out if they are eligible for an “open” work permit. " or is this just for foreign workers?

2. inland application for stage 1 takes 6 months - but I've been reading other posts where stage 1 is processed after 2 months - is that true?

What should we do? any recommendations.

if we do an inland application should he get a medical done in the UK?
how long does it take to do the application?

I can't answer all of your questions. There are some really helpful and knowledgeable members here that will for sure though.

I do know that if you come here together and apply inland, you would then submit an open work permit with the application. It does take some time for that to be processed, more then 1 or 2 months from what I have read. I think you may be refering to the outland stage 1, is it with in that time frame.

If you apply outland since he is visa exempt, he can come visit you and although he wouldn't be able to work, he can use that time to find a job. Outland also has the option to appeal should it be refused. Inland does not. Also, with an inland application, your husband would have to stay in Canada if he leaves the application would be deemed abandoned. Should a family emergency arise he would go back, thus losing the application.

If you can get all your application and papers/documents together, you can send it in even before you return to Canada to get a "head start" on the time.

Outland doesn't give your husband any status within Canada. If he wanted to be able to work, he would need to find a Canadian employer willing to get a positive Labour Market Opinion (says that a foreigner can take the job instead of a Canadian) and get a work permit from that. Otherwise, he can enter Canada without a visa as a tourist while the outland app is being processed but cannot work until he gets PR. Outland through London is sitting at around 7 months average altogether.

The accompanying spouse bit only applies to spouses coming in with foreign workers, not citizens.

I think you are mixing inland and outland times, as first stage inland is 6 months. I've never seen it processed in only a few months. If you apply inland and include an Open Work Permit app with it, he would be able to work in 6 months after the sponsor approval.

The application takes some time to get ready, all the forms, police certificates, gathering the proof of relationship. Usually around at least a month.

Outland seems best for you guys. Maybe a few months separation but it will all be done much faster and he won't have to be unemployed for 6 months and stuck in Canada the entire 14 months it takes to process inland.
