Hello everyone,

my spouse is canadian, i'm german and we are currently living in Germany. We have one daughter, which was born in Germany and our second child is expected for November. :) We just started gathering all the documents needed for a PR and came across some questions regarding our child(ren).

Our daughter was born in Germany and currently only holds the german passport. We recently filed her application for proof of citizenship (she is eligible) to CIC but we'll probably receive her citizenship certificate not before August 2015.

1) My question is if we have to list our daughter as a dependent child that also needs to be sponsored? I’m asking because she actually already is Canadian and we will probably have her citizenship certificate before I would receive my PR Visa anyway.
2) Do we face any problems if we file our PR application before child #2 is born? Do we have to mention that we are expecting a second child? For child number two, we would also apply for proof of citizenship at CIC since it will also be born in Germany.

If we have to list them as dependent childs, even though they will officially be canadian by the time I would receive my pr visa, they’d have to go through the medicals etc. too.

No, they go on the application as such. They do go somewhere else however, "Additional Family" information I think. Since she/they are/will be Canadian citizens already, they're not going to impact your application. You don't need to mention the 'expected one' until he or she arrives.

Only problem is that you should not do the medical exam (x-ray portion) while pregnant.

You can submit your PR application with a partially completed medical exam, but state clearly that you can't do x-ray now due to pregnancy, and will complete this after the birth. Just note that while CIC is waiting for your x-ray results, it may cause a delay in processing.

What do you mean by "they go on the application as such"?

In the Generic Application form for me (the applicant), it says on page 3:

"Dependant(s):
You must provide the following details about each of your family members, whether they will be accompanying you to Canada or not. You must include your spouse or common-law partner, if applicable, and all of your dependent children, and those of your spouse or common-law partner, who are not already permanent residents or citizens of Canada."

So i think we have to find out if our child is already a canadian citizen for cic, even though she does not have a citizenship certificate or passport to prove that she is canadian. We have applied for proof of citizenship but will not receive her citizenship certificate before we file our spousal sponsorship application.

If CIC says she isn't canadian until she has her citizenship certificate, we would have to pay an additional 550$ plus the medical exam. That would be ridiculous.

My wife is the sponsor and canadian so she doesnt has to do a medical. But thanks for your concern :)

If your children are Canadian, they do NOT need to be listed as dependents. And you do NOT need to pay the fees for them. Try to get the citizenship papers as soon as you can, but even in case it takes a long time then when you submit the application you can indicate they are already Canadian, and citizenship papers will be sent after.

They will ONLY appear on the "Additional Family Info" MM5406E form.

My wife is the sponsor and canadian so she doesnt has to do a medical. But thanks for your concern :)

Hi Dakov,
I have a child born outside of Canada to a Canadian father. I also have a child from a previous marriage. When we applied, we have listed both children in all the forms. We didn't know that my youngest daughter was entitled to Canadian citizenship, we just found out about it when she was already older than 2 and a half. My husband received his money back for our youngest daughter and we were told that she shouldn't be part of the sponsorship process. We have applied for her Canadian Citizenship Certificate and although they said it would take up to 1 year until we'll get it, it was ready in 6 months.
Children under 2 years and a half can receive a temporary passport based on their citizenship certificate so don't worry about the unborn child, just file the papers for his/her certificate as soon as you hold her in your arms. Then also inform CIC that she was born and she is a dependent Canadian Child. She doesn't need a visa, just her passport.

Ok, I will not list her as a dependant but attach a note to the additional family information, explaining that she is eligible for canadian citizenship and that we already applied for it.
