Asking for a friend. My friend is a PR and her would be husband got refugee refusal back in 2021 and he is in his home country at the moment. If she applies for his spousal sponsorship, how difficult is to get the approval? They are family friends from 10 years now getting married soon. Does he still have a chance to get approved?

He certainly has a chance of being approved. It will be important to show the relationship is genuine and not being entered into for the purpose of getting PR status.

He will most likely need to go through the ARC process to return to Canada. If he was removed from Canada at Canada's expense, he will need to repay the costs of that flight. He should expect processing of the application to take longer than standard processing times.

Would add that in person time while in a relationship will likely be an important factor. Would not advise the PR to return to their home country for a quick engagement and marriage and then return to Canada right away and apply for sponsorship.

Thank you. They are engaged since Jan 2023 and planning to get married April 2025. Does that make sense? And they are family friends from over 10 years.

The amount of in person time in a relationship will likely influence how much concern there is about whether the relationship is genuine.
