Spousal Sponsorship a few questions (New Zealander)

Hi there. My common law partner is going to sponsor me soon as we would have been together 1 year. I have a few questions however. Currently I have an application awaiting to be fully processed for a work visa. I am being sponsored by a company. I am on a visitor visa until Jan 2013 or until my new work visa is approved. The outcome of the work visa will very likely be decided before my visitor visa expires. We have a 1 month trip back to my country (NZ) for the month of Feb 2013

So... If we apply for spousal sponsorship in December 2012 and I have a current work visa and we leave the country in Feb. Am I granted re entry into Canada when we return?

The visa also states we must take up PR in Canada once the spousal sponsorship is approved. For how long is this referring? What if we were wanting to live 1 year abroad at some stage?

Also have just noticed you can apply to an outside visa office. Does this mean I can apply to the Sydney office ( I am kiwi however) and i t will be a faster processing time

Only if you have the work visa. If it's as a visitor, you do not have the "right" to return. Not saying you'd be rejected, just saying it wouldn't guarantee that you get back in. Also, if you apply inland, if you are rejected at the border, they consider your application abandoned and you would have to start all over again.

2 out of 5 years is the min.

Yes. You can do this while "visiting" in Canada.

So, it's best for me to apply before I get my work visa? This way I can apply outside Canada. Is there no way to apply outland whilst on a working Visa? Chances are my work visa will come first, meaning my status will change to worker. Our tickets are booked back to NZ so hope there is no problem upon return.

Hey Cam,

Do you already have your LMO for your work permit? If you have an LMO then you can flagpole at the border to get your work permit seeing as you are from a visa exempt country (and then you don't have to wait the 2-3 months or whatever the wait time is at the moment). Not sure if you are in a hurry to start work, but if you are that can save you some time.

I would get your application for PR completed and ready to submit as soon as you receive your work permit. Part of the work permit application is proving your intent to return to your home country once it expires, so if they see a PR application that has already been submitted then that may conflict with your WP. The process of getting your PR application can take some time too depending how many countries you have lived and gathering documents and letters etc. It is not hard, just time consuming.

Yes definitely apply outland through the Sydney office. I am keeping track of Sydney applicants for this year and the spreadsheet is in my signature if you want to check it out. The website says 8 months to process, but most people get it within 4-5 months. It is way faster than inland and allows you the right of appeal, plus the ability to travel in and out (with a WP this won't be a problem). The downside is that if an interview is requested the applicant will have to travel to Sydney for the interview but this almost never happens with the Sydney office.

So am I still ablt to apply via Sydney once I have received my work permit. I don't have a work permit yet, just a case number saying that it is in processing.

8) Cool! Thanks for your help. One last thing. Is a interview required or is it not certain if one will be required. Would hate to have to buy a ticket back again :(

It's not certain if one will be required. They almost never do them at the Sydney office from what I understand, but there's of course no way to be sure.

for most visa-exempt countries, interviews are quite rare, as there is less suspicions that you are immigrating only for the benefits of being in Canada - as you could have the same quality of life in your own country. The only reason for you to be in Canada is probably because your spouse is there - not much else....

So - if you prepare your application well, with all proofs of your relationship, how long you have been together, pictures, letters, rent lease, bank account etc ( all listed on the guideline), then it is unlikely that you will be called for an interview. You can not rule it out completely, but it should not be a big concern... unless you have some red flags in your application (huge age gap, different religions, previous marriages and children etc - all together!).
