Hello All,

I had a question some days back that if my spouse can apply for work permit while her PR applications is under process. And someone in the forum did answer saying that i need to apply as a Inland application to be considered for work visa.

Now my other question:
She is the US and has a valid Canada TRV. Does that qualify her to move to Canada with all her stuff? How does the Border treat her entry. I can definitely file for the PR (outland) and get a confirmation in principle but that wouldn't allow her to be eligible for OWP.


About Me: I am a Citizen and have been living in Toronto for almost 6 years now.
She: An Indian national studying in the US and about to graduate in May. Her employer decided not to sponsor her work permit given the current situation.

No she cannot "officially" move with all her stuff since her inland application is in process and she does not yet have a positive decision (granting of PR). If she submits her inland spousal application and her OWP application together she will be under "implied" status until a decision is made on the inland application. This means she does not have to keep submitting her visa extension beyond the six months normally given. Whilst her inland application is in process with the OWP application, she can start to work once the OWP has been granted (takes 3-4 months).

No, a TRV most certainly does not allow her to move to Canada with all of her stuff. Trying to do so is a good way to be refused entry AND potentially be issued a one year Exclusion Order.

She can enter Canada as a visitor, with the standard few bags like a normal visitor.
