Spousal application, owp, implied status?

Hello everyone,
I really need help since I have bene trying to find a solution but coudnt. I hope you guys can give me some ideas.
I came here in June with visitor visa, then I got married with my husband, we applied for Spousal inland in September and already got Aor. Afterthat, we applied for Owp (since we didnt include it together with Spousal app) last week 18 Oct.
I have called the agent of Cic, they said that as long as I sent out my spousal app and owp, I automatically have implied status after my visitor expired (December). But I am wondering something, how about if my owp gets refused due to some mistakes? Then I will be out of status after December? Should I apply for visitor extensions? If I apply, how about if I get my visitor extension refused?
Sorry to have so many questions regarding “refused” but better be aware than nothing.

The most common reason for its refusal is if you didn't pay the full amount ($255) or forgot a signature. If you got took care of these two things and you got your documents in order, it's unlikely your OWP will be refused. If you haven't received word about your OWP and your visitor visa is about to expire, go ahead and apply for an extension if you want to play it safe. You'll hear back about your OWP before you hear back about your visitor extension.

No idea what to do in the event both OWP and visitor extension are refused. Maybe someone else here knows.

If you got took care of these two things and you got your documents in order, it's unlikely your OWP will be refused. If you haven't received word about your OWP and your visitor visa is about to expire, go ahead and apply for an extension if you want to play it safe. You'll hear back about your OWP before you hear back about your visitor extension.

No idea what to do in the event both OWP and visitor extension are refused. Maybe someone else here knows.
The application for visitor extension also gives implied status. So if you apply for the extension, get your OWP refused, resend the OWP application before the decision on the extension, you can get your OWP before you even hear back on the final extension decision. If you do get refused on the extension before you get OWP approval, then you're out of status and can't apply for the OWP until AIP which is near the end of the whole PR process and you'll generally get your PR before you get your OWP in that case, so it's questionable if it's even worth it to apply for the OWP.

@Baobaochlos when in December does your status expire? If you're gonna apply for an extension, as long as you do so by and including the last day of your legal status, you're good. So there's no need to decide anything or apply for anything right now. The extension application is basically a $100 peace of mind. I don't think OWP applications generally get sent back past the two, two and a half point mark and they only get sent back if you messed up the payment (did you pay $255?) or forgot to sign or something like that.

Since you have applied after you submitted but before approval-in-principle, I'm not sure if CIC will hold your application or return it to you as untimely.
Oh, I didn't know you had to wait for AIP if you don't apply with the PR application. I was under the impression sending it all together was the simplest and fastest way to get it done, but that you can send it at any point after as well. Interesting.

The website doesn't indicate that it must be sent at the same time as the initial application, so I'm probably wrong, but it may still take a while.

I did pay the right amount for Owp and signed everything. But Im just wondering because I cant live in peace until I hear from them. I prefer having ideas what do I have to do if that comes or this comes so at least I can prepare in time. Thank you so much.

Yes, before you have AIP, you have to send owp by mail. After you have AIP, you can send owp online :)

Hello, thank you so much for your support. My visa expires on 20 December. I applied for Owp 18 Oct. im just worrying if I get refuse my owp after 20 December. That means I have to leave Canada immediately ? As well as having my inland app canceled ?
Anyway, I have read from the cic that the extention application of visitor must be sent 30 days before the status expired? Is it ok if I extend it less than 30 days before it expires?

No, you don't need to leave. Spousal PR applications do not need legal status at all in order to be processed. There are many people who were illegally in Canada for years before applying and they got their PRs normally. You only need legal status for the work permit. If your status runs out and you get your OWP application returned, then you wouldn't be able to reapply for the work permit until almost the end of the whole PR process. Your PR application would proceed normally.

If your status expires on Dec 20, you need to send in the extension request by and including that date, not 30 days ahead.
