SPONSORSHIP WITH LEGAL SEPARATION

Hello,
I am living in Canada almost one year (extended visa) with my boyfriend who has been legally separated for 5 years. He is now in the process of obtaining custody of his son, it is quite slow, his lawyer recommended him that he should first do custody and then the divorce. My question is if we can do the sponsor process only with the separation agreement?. thank.

Once you have lived together continuously for at least one full year, he can sponsor you as his common law partner. He doesn't have to be divorced.
