My boyfriend is in france. We fell in love when he was in france. He case got rejected and he got a letter for deportation to srilanka. I want to get married to him and sponsor him to Canada.
I cant get married in france beucase he doesnt have a status in france.
Will the deportationn be a big red flag when sponsoring him?
When i get married to him in srilanka will the deportation from france be am impact when sponsoring him to Canada?

I dont know what to do.

Help :( :( :( :( :(

Yes unfortunately, being a failed refugee claimant, is a huge red flag, because it shows your husband is very desperate to leave his country, and will do everything it takes to not go back there. In your husband's case, he seemed to have tried many ways to stay in France, and he was rejected every single time, so I think this will make it very difficult for you to sponsor him.

One of the things CIC will ask you in an interview is what will happen if they refuse his PR application? What will you do? He was refused PR, so you guys can't live in Canada. He has tried many ways to remain in France, so you guys can't live in Sri Lanka, because he clearly does not want to go back there. These are things you need to consider

In addition to what mikeymyke said, the success of your sponsorship application will depend on the strength of your relationship. If you are in a genuine relationship, and can support that with good quality evidence, there should not be a problem, even with a failed refugee claim in France.

So even with good quality proof ( proof from family members, emails, chatlogs) I dont have to be that worried about sponsorship??
I am planning to get a lawyer to help me with the process.

Thankyou

Your case will be difficult because of a few "red flags". The failed refugee claims are big red flags. And getting married right after a rejection will also look very suspicious to CIC. They will look very closely at your relationship. How long have you been together?

We been together since 2012. he got rejected 2013.
Do you think if waiting will help the sponsorship process?

If you have good evidence of your relationship going back to 2012, that helps.

It will help, but you guys will definitely get an interview based on his multiple attempts to remain in France. And on the interview, they will ask about where you will live if they refuse his PR, and you need to be prepared to answer it. It's the very last question they will ask, but one of the most important, and frankly, I think that's a question you should ask yourself too, if he really was refused his PR, where will you and him live?

But the problem is, your husband clearly does not want to live in Sri Lanka because he filed a refugee claim, that means he feels his life is in danger and he does not wish to go back. So the VO would assume that if he doesn't want to live there, how could you decide to live there with him?

I think the best way to maximize your chances of a successful application is to let him go back to Sri Lanka, maybe even live there with him for 6 months to a year, and try again.

The OP needs to talk to an experienced lawyer. The case has too many red flags.

Generally, married people want to live together in once place and waiting too long after marriage before you sponsor him will raise more questions.
Good idea to get an experienced immigration lawyer. They will be able to review your entire file and help you address any potential red flags. Best wishes.

I don't know what to do. The sponsorship lawyer mentioned it will take 3-4 years for the sponsorship process to be approved. But it is also not 100% sure.
I want the sponsorship to work out. What can u do.

Forgetting about the wife's answer to this question, what should his answer be? Obviously if he is rejected for immigration he has to go back to Sri Lanka, regardless of if his life is in danger. (and the current regime in Sri Lanka is guilty of war crimes under international law, so it is quite possible he is really in danger). Where is he supposed to go? Mars?
