Dear all,

This is my first post for any forum. Usually I am tempted to read all of the topics, but at this time I am posting myself as I have not found a similar case.

We are a family of three, living in Pakistan and we want to move to Canada:

1. Me - I have already applied for Federal skilled worker program last week.
2. My younger brother wants to go and study in Quebec. He intends to apply soon.
3. My mother (my father passed away 10 years ago) - is dependent on both of us. We (both brothers) earn respectable salaries and look to be in a good shape to move.

I have a sister who lives in Canada with her husband. Her husband earns enough (easily) to sponsor / support my mother in Canada.

The new policy for sponsoring parents/grandparents (which was closed in November 2011) is opening in January 2011.

Super Visa: The rejection rate in Super Visa is low (about 20% globally), but one has to show his "Purpose of Visit" and "Ties to home country", which is somewhat contradicting with our intentions since we want our mother to move as well. My mother has visited my sister twice on a Temporary Resident Visa (6 months). At that time we showed her two sons i.e. us (2 brothers) as her "Ties to Pakistan". But now as I have applied for immigration myself and my brother is planning for a study permit, my mother's "ties to pakistan" and "Purpose of visit" would become weak, resulting in lower chances of approval.

Parent Sponsorship: If my sister sponsors our mother (she lives in Quebec and my brother is intending to go to Quebec as well for studies), it is generally considered to take too much time. There were huge backlogs in CIC for this. People have waited for years and years. Some applications refused. Now they say that they have cleared their backlog, improved the system and the policy. But I anticipate that sponsorship may again take too much time. And if we apply for her sponsorship we know that parent sponsorship is the last priority for any government.

Should I apply for a Super Visa or Sponsorship, for my mother?

My question actually relates to the opening of parents sponsor policy (with Super visa to continue) and its implications on our decisions.

I am asking this after reading much of the stuff on the CIC website and this one. I have also done other internet searches too.

I know its a long post. I will be really thankful to you for any information / replies.
 
My initial thoughts on this are..

1) A super-visa is not going to permit your mother to "move" to Canada. It's for long visits, nothing more. Each visit can have a further duration limit imposed by the agents at the Point of Entry.

2) Sponsorship of parents is going to be strictly capped and the cost/commitment is increased. At this stage it's impossible to predict how those factors will affect overall processing times.

I think that you are correct to be concerned that the application for a super-visa will be refused.
 
How about getting your mother's super-visa before your brother applies for study permit?

After getting the super-visa, why not start sponsorship procedures for your mother, maybe you can get it before the visa runs out :)

I think that the new sponsorship requirements are more stringent with the application of caps. There must be updated Forms, Guides, instructions etc on websites, which at this time are not present and therefore, sponsoring parents is not a clear.
I can apply for Super Visa and then after wards, when things get clearer, I ll go for sponsorship.

1. Can we apply for Parent Sponsorship when we are on Super Visa?

AND

2. Can we apply for Super Visa when Parent Sponsorship is in progress.

Whatever you decide, only a Canadian citizen or a permanent resident can apply for the Super Visa or sponsorship. So, it's all your sister's responsibility for now. You can't do anything until you become a permanent resident.

Keep in mind that as part of the new requirements, your sister and husband would have to show income levels sufficient for parent sponsorship, for 3 consecutive years preceding the application. The only acceptable proof for income is official Revenue Canada notices of assessment.

Thanks Rob_TO. Yes I know this and I have checked this. My sister has completed MS in Quebec and her husband meets the income thresholds and the requirement for three years.
