Hi,

I currently study in Canada as international student, meanwhile my step father has opened sponsorship application for me and my mom. However, the graduation date is coming near for me while the sponsorship application is still uncertain (maybe 6months or 1 year of waiting). Plus, I am turning to 23.

As I know if I now finish school and go to work, my dad won't be able to sponsor me as dependent child. Thus, I come up with the idea:

I will continue to go to school here in Canada. But not for master or another bachelor degree (Too expensive for intentional student as I have suffered last 5 years). Instead, I will study diploma or certificate.

My question is: Would it be considered as full time study ? I'm a bit worried since CIC website only tells me that as long as I still depends on my parents and go to school full time, I'm ok to be sponsored. Hmmm .... quite confusing and challenging.

P.S.: I'm not afraid of working, but taking the risk of failing our sponsorship application is quite unacceptable.

I believe your age is locked in at the time the application is sent. If you were 22 when the application was received, then you will be fine.

But seniors on this forum could confirm that.

If you were UNDER 22 at the time the application was sent, you are fine. If you were 22 or older, you must remain a full time student, dependent upon your parents for you to be included in the application as a dependent child.

You need to be in full time education until you obtain PR.

If you read http://www.cic.gc.ca/english/resources/manuals/op/op02-eng.pdf section 14 it is all about how to ascertain if the person is a classified as a dependant or not, when in full time education.

Yup, my dad started on Apr 2009 when I was 21... I have attended university since 2006 and haven't skip any period.

>>> Thus, I am qualified for dependent child over 22

But after this year, when I'm done with university and I will graduate in May 2011, would I still be dependent child if I go to another college for diploma or certificate.

>>> Hope this will clarify my question.

Thank you very much for your answers.

I'm not really sure if you mean April 2009 is when your step dad and your mum got married, or when he submitted the application to sponsor her. It would seem unlikely that he applied to sponsor her 18 months ago, as spousal sponsorships are usually finalised faster than that.

When was your step dad's application to sponsor your mother received at CPC Mississauga?

If that date was before your 22nd birthday, then your age is locked in and you remain a dependent on the application as long as you don't get married or enter into a common-law relationship.

If that date was after your 22nd birthday, then you need to not get married, not enter a common-law relationship AND remain a full time student - i.e. you must go back to college full time and remain full time after you graduate until PR is granted if you wish to be included as a dependent in the application.

Yup, Oct 1987 is my date of birth ... so it must be before I turned to 22. (Just 6 months before my 22nd birthday)

The reason that our application is taking so long is : our application was arranged to be interviewed ... we got interview-informed letter but it does not state when or how long we have to wait ... ?

As you said: My age was locked at "dependent child less than 22", If I graduate now and won't get married or common-law situation, I will be fine, won't I? So, I don't need to go to college to extend my status as above ?

Hmmm ...

Thank you for your reply.

I don't really get your question here.

But the sponsorship application was received in early Apr 2009. My parents got married in late Dec 2008, applied for sponsorship in Mar 2009. <<< Hope this is clear enough.

I know the application has it own issue (that's why it is taking so long), but I am more concerned about my status since it's not clear what I should do now after graduation.

That's correct. The application was received before you turned 22, so your age is locked in. Therefore, you don't need to remain a student. You do, however, need to not get married or become common-law.

Also, about the locked status, this might be my 1st time hearing this, I wish to know more since this info is quite helpful for my question.
