Sponsorship - dependent child - pls guide - from a single mother

Hello,

I am a single mother and need your kind advice / support from senior members.
I became Canadian Permanent resident in March 2008, was out or Canada till June 2009. During this period, I had a baby girl who was born outside Canada in May 2009. I came back to Canada in June 2009 and applied for sponsorship but have to leave immediately. As I was not in Canada, CPC declared ineligibility. The final decision regarding refusal was communicated in October 2010.

I left my small daughter all alone, came back to Canada in October 2010 and applied sponsorship again. I got approval from CPC Mississauga by end of November and I was informed that my file will be moved to CHC local office. As of today, I have not received any notification regarding file number and notification from CHC.

I wanted advice on following:

1. The processing time for infants / child is lower or it is same. How this can be minimized.

2. How much time does it take to transfer file and opening it.

3. The time period for final decision does take the time as declared on CIC web site for sponsorship of an infant.

4. As my application was processed before, will new application will be processed fastly.

5. How I can I request to expedite my application.

6. Can I request on humanitarian grounds as my small daughter is all alone with my parents and she is in stress, depression and secondly, I feel insecure about her.

I will request each senior member to guide me how to proceed or what to do to make processing of file much faster.

As far as I know it is officially the same. Unofficially they may try to process applications from very young children more quickly.

They will send it from Mississauga. There is no info on how long this takes, but it is not really a factor in the length of processing. The time it takes varies by visa office, and by the case. Presumably the CHC in your country now has the application. Some visa offices have a big backlog of cases; in these countries it will take some time before they open the file. How long it takes to open the file can be guessed from the average processing times on the CIC website: http://www.cic.gc.ca/english/information/times/perm-fc.asp

Yes. The times given on the CIC website are averages, though, so some applications are done much more quickly. A very straightforward application with nothing missing and as much proof as needed will most likely be done more quickly than the average.

No. The previous refused application won't help the current one.
5. How I can I request to expedite my application.
You probably can't influence the time it will take. The only way to get it done faster is before you apply, by making sure everything is in order and all proof has been submitted. You could try contacting your MP's office, telling them your story, and seeing if your MP could help expedite things.

Humanitarian and compassionate grounds only come into play if the application is refused. Again, though, you could try contacting your MP.

Hello

Pls let me know how I can request CHC local office to expedite the process. Is there no policy that we can refer to with regards to an infant who is all alone with parents and sibilings. Kindly help me in this regards. Can I be informed that what is average timeline for processing sponsorship application for an infant less than 3 years. The ormal time period is 12 months, can this be minimized by any way.

Have you tried applying for a TRV for your daughter to join you in Canada? Did they refuse? There is a small chance that if you have been refused for a TRV, you might possibly be able to get a TRP for your daughter to join you. TRP, formerly known as a ministers permit, can be granted to people who are otherwise inadmissible to Canada but might have some H&C grounds to be allowed to enter anyway. There have been a couple of people on this board who said they had been allowed TRP's for babies that needed to be sponsored after having been refused a TRV.

Hi Leon, I have recently applied for TRV and that has been refused in January 2011. Can I apply for TRP with a fact that its PR application is in process and I have already got sponsorship eligibility.

You can try based on H&C grounds that your daughter who is only a small child is not doing well without you and you must stay in Canada to sponsor her and have already been accepted as a sponsor like you said.

Thanks, thats great to hear.

Please let me know whether TRP can be applied in Canada?

What is processing time associated with it?

Shall application be submitted to CPC Mississauga?

Will it affect permanent application which is in process?

Kindly guide as this seems a great way to move forward.

I do not know the details. I have only heard a couple of people having mentioned having applied for it at the embassy after having been refused a TRV to take a child with them to Canada and having no other options.
