I am a PR of Canada. I am getting married in the last week of April 2015 in India. My fiancee is on a study permit in US and she just finished her double Masters. She also has a Canadian visitor Visa. So I want to sponsor her for PR once we are married. I am not sure of the exact procedure as to how to sponsor her for PR.

After our marriage both I and my fiancée are planning on flying back to Canada. Can she come to Canada with her visitor visa? If she does come to Canada on her visitor visa she can stay here for 6months right? How can she extend her stay in Canada?

Should I apply for her PR from within Canada (inland) or from India (outland)? From what my friends tell me applying for PR from outside Canada is a lot faster than applying from within Canada. But the one advantage to applying from within Canada is that if she gets an open work permit she can work in Canada as her education in the US is valid in Canada.

I am working at a big corporation in Canada but I am only getting 2 weeks vacation for my wedding which is not enough so I am going to quit my work as wedding is a once in a lifetime event and I haven’t been to India in 4 years.

Will there be a problem to sponsor my fiancee if I am not working when I put through the application for her PR? I have about $80k as savings in my deposit account I can show that to CIC. Also I don’t have to pay for rent or Mortgage as my parents are also in Canada and we own our home outright.

I cannot put up the file until I am married correct? Also my fiancée has been in the US for the last 4 years so does she need to get Police clearance from the US?

I am a little bit confused with regard to the Spousal PR. According to the CIC website there are 3 parts to the this application. And from what little I am read on this forum I first need to apply to be a Spousal Sponsor and once that is approved I can put my fiancee's file?

I would greatly appreciate any help I can get. ;D
 
She can visit with her visitor visa, however she must act like a visitor. Showing up with all her possessions could her sent back. The length of the stay is up the CBSA officer. If nothing is stamped, then she gets 6 months. She can extend her stay online.

Take a look at the Delhi threads to get an idea of the processing times. I think it's usually pretty fast. Inland will take 2+ years. She should not leave the country during that time.

There is no minimum income requirement to sponsor a spouse. You cannot be on welfare or bankrupt. If you show them your work history, as well as a plan, showing how you plan on supporting yourselves, I don't think you'll have a problem.

You can only apply if you are common-law (have lived together for 12 consecutive months) or married. She needs to get police clearances from all countries where she has spent more than 6 months, so yes, she must get one from the US. She should apply for that now, since I think they're taking 3 months at the moment.

You must send all parts of the application together. Sending in only part of the file will result in it being returned to you. Send the sponsor's portion, the applicant's portion, and all supporting documents to Mississauga. After sponsor approval, they will forward the whole thing to the applicable visa office (if outland), or it will sit and gather dust for a year and a half (inland).
