Sponsoring second marriage , principal applicant for first marriage

Hello,

I am currently married and will be the principal applicant for EE in canadian experience category.

Unfortunately, we plan to divorce soon after 7 years. But in the mean time it looks like we ll get the PR’s.

My questions are:

1. Can I sponsor my future wife or partner?

2. Is there any time limitation for that?

Firstly, if you are planning to divorce, your spouse must be removed from the application or at least changed to non-accompanying.
Your spouse must not become a Permanent Resident as your dependent if the marriage is effectively over.

If you don't do this, it will be considered as possible immigration fraud/misrepresentation.

Once you have landed and are free to marry again, you may do so and sponsor a new spouse.

Actually, divorcing part is not that clear, we are still considering staying married. It comes and goes. The reason I ask this question, if we got the PR and changed our mind, does this prevent to sponsor for a new partner?

Also does it have the same procedure for primary applicant and becoming a sponsor?

If you divorce soon after becoming Permanent Residents, and then remarry / apply to sponsor, you can expect your application to be examined very carefully for evidence of prior misrepresentation. There is no legislation that prevents this or applies any minimum time period but it will appear to be suspicious.

I checked the process for sponsors, if a partner sponsored someone, after divorce he/she can not be sponsor in three years.

So, in this case this will not happen for us?

This is not applicable. You are NOT sponsoring under a Family Class Sponsorship. You are applying as a PA + dependant under an Economic Class application.

If your relationship has already broken down you should declare that to IRCC now, or they will likely suspect you for marriage of convenience in the future.

Thank you for your reply. It is not officially right now, we gave some time for both of us to consider again.

To be honest it sucks while we are in this transition period. Our aim is not to cheat the system, we have almost 8 years of marriage and a child. So, it is not so easy to say broken.

I was curious about the procedure if we separated after PR and consider marry again. That is also on the table for future, if our relationship does not survive.

What I’m totally confused and maybe someone can shed some light on this . The o/p originally said divorce is in the works , and they are planning on getting a divorce , then in the same posting how long does someone have to wait till they can sponsor again , then in another reply , no, we are just thinking about going down the divorce route , but it effect want to get that PR in the bag for the wife and child presumably.
You already mentioned you’re planning to divorce , the relationship has broken down , by not mentioning it too the IRCC it’s immigration fraud
Somethings up, asking about how long one has to wait before sponsoring someone else , is like putting the cart before the horse

I wish it will be simple like that, but it is not. Thanks.

They can apply her own and get the pr by themselves. But we already started a process.

As i said it is not simple math, we decided to divorce but than tried to save it and similar situations still going on.

I can understand, it would be hard to understand if you are not the same situation.

So from your comment I understand i need to change the status if there is a broken relationship.

Do you have another relationship already that you want to sponsor?

I'm sorry that this is happening to you, but if you sponsor again, after divorcing so close to a PR, there may be some extra scrutiny.

Right now no I do not, we are still trying to figure out our problems with my spouse, but if i decide to move on, in time maybe a year, why not.

Because a year after divorcing, if it's very close to when you received your PR, is what makes IRCC think your new relationship is fake.
