Hi,

My pregnant wife is living with me in Canada. She's on a student visa, which will expire a month after her expected delivery date.

We've decided to apply outland. But I'm worried about a few things:

1. Due to her pregancy, she can't have her medical exam until after the child birth.
2. She can't continue her study and therefore wouldn't meet the requirements to extend her student visa.

My questions are:

1. Can we submit our sponsor/PR application without the medical? If yes, when would be the best timing to do so? ASAP, or shortly before her delivery?
2. Can she apply for a visitor visa (instead of extending her student visa) while waiting for the PR application result?
3. If we apply before her delivery, what additional documents should be provided after the baby is born?

Thank you.

1. Yes, but instead of not doing the medical at all, it would be better to do all of it except the x-ray (the rest can be done while she's pregnant). Submit it as soon as the rest of the application is ready. They won't finish processing without the x-ray, but they will start, and if everything goes well, they will have everything else processed, including the background checks, before the birth, and just be waiting for the xray.

2. She should apply for an extension of status as a visitor. You should submit this before her student visa expires. Asking for 6 months status as a visitor, with the reason being that she wants to remain in Canada while her outland PR application is finalised is appropriate. Include proof of support, and proof the PR application is in progress (printout from e-CAS should suffice, although they can check this themselves).

3. If you apply and send everything else in now, then all that will remain after the delivery is to go and have the x-ray, and notify the visa office that it's done. Then they would finish processing the application.

Edit: here's the link for the extension of stay / change conditions to visitor:

Thank you! Your answers are very helpful. :)

Regarding #3, should we provide any documents about the baby? Her family members will be changed because of the baby, right?
