Sponsoring my brother under other-relatives

Hello there...

I tried to sponsor my younger brother "he is 24 yrs old" under other relatives. but the application was refused for the following reasons, they said:

• you have not submitted an application for a member of family class. you have at least one relative who is a Canadian citizen, registered indian, or permanent resident of Canada, or there is another individual who you could otherwise sponsor, therefore the application does not meet regulation 117(1)h. as such, you do not meet regulation 130(1)c.

I am very sure i submitted every single document they asked for.

two months ago they sent me a letter asking for the following documents:
• A completed Family Information Sheet for Sponsorship under R117(1)(h) for yourself This must be
received at this office by: 15/01/2013
• A separate and newly completed Additional Family Information form (IMM5406) bearing original
signatures for the person(s) you are sponsoring. This must be received at this office by:
15/01/2013.

i do have a living parent and i also have step brothers who are under 18 years old.

Can someone help explain the reasons why the application was rejected. is it because the living parent or the other step brothers who are under 18?????

Most likely because Canada normally allows parent sponsorship (although it is suspended for the moment). Because you would be able to sponsor your parent when CIC begins to take applications again, you cannot sponsor your brother.

You should look into your provincial programs. Some allow sponsorship of other family members with job offers.

You have a living parent. You can't sponsor your brother.

thats correct and some where along the checking they found out u have someone close to u in canada already maybe from the family information where u put their address its only if u dont have anyone in canada brother sister uncle aunt niece nephew parents grandparents

You can only sponsor your brother directly if you don't have living parents.
Otherwise you'd have to wait for the Parent Sponsorship to start taking applications again and then you could sponsor your parents with your brother as their dependant. But then again, he'd have to be a full time student since attaining the age of 22 and supported by your parents to be eligible.

Response: I believed that if you do have parents you can sponsor them under the Family Class. The sponsor under the Family Class can sponsor the ffg: 1. husband or wife , 2. common law partner 3. parents, children below 18 years old. 4. grandparents.

Response; Sponsoring "other relative" you should use Form 5196. This gives you the whole package. Read the guide on how to fill in all the several sets of the entire package.

I believed you can sponsor your brother (if you like to) but not under the direct Family Sponsorship. It is under "other relative" granting that you don't have any individual already now in Canada sponsored by you under the Direct Family Sponsorship.. Who are these? parents, husband or wife, your children below 18 years old and common law partner. This means you are ALONE in Canada.. So, you can sponsor any of your relatives regardless of relationship and age (according to the guide in how to fill in Form 5196). Thus, your program is Family Sponsorship, and your category is "other relative"..
