I am a Canadian Citizen and my fiance is currently in Canada with an open work permit. She has an application underway for Permanent Residency under a Provincial Nominee Program.

We plan to get married soon. Her work permit was only extended due to her Provincial Nominee Program. We met while she was on vacation in the province I live in, however, she has to return to the province she was nominated in to continue her eligibility for her PNP.

Her open work permit was only extended due to her application under the PNP.

If we get married, can she drop her application for PNP and instead extend her work permit through the Spousal Sponsorship Program?

I am asking because we want to stay together and not be separated (we are glued to one another!). So I would rather sponsor her as a PR, instead of her return to the province she was nominated in or ever have to leave Canada.

Thank you for any advice you can all provide!

You can get married and sponsor her. However, if she holds a closed work permit, she will not be able to just continue working. You could apply for inland sponsorship and include an OWP app but it will take 4 months for the OWP to arrive.

So she still has an open work permit?

How long does the PNP usually take?

If she needs to maintain a work permit, you can sponsor her inland concurrently with the PNP and apply for the inland work permit (that takes at least 4 months to receive). She needs to have valid status in Canada to apply for the work permit (so a valid work permit or visitor visa/status).

If the PNP process is going to take less than a year, you could just move with her until she gets it. Sorry I am totally unfamiliar with PNP and how it works.
