Sponsoring British National-Need help(Outland App)

Hello Guys,

I have question regarding spousal sponsorship of a UK national.
My fiancee´ is living permanently in Pakistan but she is a UK national.Hopefully with the grace of GOD I will marry her next year.
She goes to UK like every year or so to spend her vacations and then returns as her whole family lives in Pakistan.

My question to you is that the processing times for spousal sponsorship application made from Pakistan may take upto 26 months but in UK the same application could be processed within a matter of 6-8 months max.

Is it illegal if we do the out-land spouse application from UK?????

If it is not illegal then do I need to get any kind of special documentation before submitting my application?????

Also I heard that if you have lived in country for more than 6 months after the age of 18 then you need police certificates from that country. She has only gone on vacations and her maximum length of each stay was not more than 2-3 months each year she visited. Does she need police certificates from UK?????

Please advise!!!

On your application you can choose either the country of residence, or the country of nationality, so in your case you can choose the UK. However, CIC can decide that it is more relevant for the application to be processed somewhere else, depending on the case - so you can ask for UK as a VO, but your file might still be sent to Pakistan if CIC decides that it's more relevant, given the fact that she resides in Pakistan with her family. In that case you will have to wait the 26 months.

If she hasn't stayed in the UK for more than 2 or 3 months at a time, then she probably doesn't need any police certificate from the UK.
