Sponsoring a wife.

Hi Everyone,

I recently got my immigration and just landed few days ago.

I want to sponsor my wife.

I got married just 3 months before I got the Immigration and didn't inform them at the time I was sending my passport for the visa.

I told them later but well before landing sometime in August, 2008.

Please see below the communication with the Immigration Office.

This is to inform that my marital status has been changed. Please note that only my wedding registration has taken place, but the final reception is still due and unplanned at the moment.

My plan was that I will go to Canada at the end of December, I will settle down my self there and then I will do the 'Final Reception' and then I will call my wife, but now I am thinking to do the 'Final Reception' before I go to Canada and take my wife with me before the 16-01-09, which is the expiry date of my visa.

Kindly advise how I can proceed with under these circumstances. ]

We acknowledge receipt of your correspondence informing us of a change in your family composition due to marriage.

If your spouse is NOT a citizen or permanent resident of Canada, he or she must be examined in the context of your application, whether or not he or she will accompany you to Canada. He or she will have to undergo a medical examination. We will send you the appropriate form upon reception of the documents listed below.

In order to add your spouse to your application, we require the following documents:

-your original passport and confirmation of permanent residence (CPR) document
-processing fee for your spouse (if accompanying you to Canada)
-notarized birth certificate of your spouse
-copy of your spouse’s valid passport
-recent photographs of your spouse according to the specifications
-police certificates from all locations where your spouse resided for more than 6 months since turning 18 years old
-a completed application kit with all the requirements
-updated IMM0008 Generic and updated IMM5406 “Additional Family Information” form for yourself.
-a “Certificat de Sélection du Québec” for your spouse (in his or her name), if you wish to immigrate to the province of Québec (http://www.micc.gouv.qc.ca/fr/index.asp)

Copies of the original documents with original certified translations into English or French are required. All documents must be sent by mail or fax (see fax number and address below.

Application forms, fees schedule, payment methods and photo specifications are available on the CIC website: http://www.cic.gc.ca/

Please note that your visa will expire on January 16, 2009. We are unable to extend the validity of any visa once it has been issued.

If your spouse does not accompany you to Canada then you can sponsor him or her from Canada under the Family Class immigration category, provided you meet the sponsorship criteria. Information about bringing family members to live in Canada can be found on the Citizenship and Immigration Canada (CIC) website at http://www.cic.gc.ca/english/immigrate/sponsor/index.asp [/b]
For future reference, please quote the primary applicant’s full name and date of birth, and the file number in all correspondence sent to our office.

My wife hasn't gone through the examination process yet.

- As you have already landed in Canada. No need to worry about communication with the Buffalo visa office. It was right to inform the visa office about your marital status change. Now you can sponsor your spouse under family class. Go to CIC website and check the application procedure for sponsoring your spouse.

Nope, the OP has screwed up, he was told that his wife had to be examined and in his post she wasn't. So she is no longer a member of the family class and cannot be sponsored. Time to hire a lawyer to protect himself from being reported for misrepresentation.

Did you read the last paragraph of the reply from the Immigration Office.

They are advising me that because my visa cannot be extended, therefore you can sponsor your wife from the Canada.

Please advise.

It says if you meet the sponsorship requirements, read above it. It says your wife must be examined. She wasn't, game over. Read Section 117(9)(d) of the regulations.


Excluded relationships
(9) A foreign national shall not be considered a member of the family class by virtue of their relationship to a sponsor if
d) subject to subsection (10), the sponsor previously made an application for permanent residence and became a permanent resident and, at the time of that application, the foreign national was a non-accompanying family member of the sponsor and was not examined.

Send a fax/ email or postal mail to the Canadian consulate general in Buffalo. Inform them that you have already landed in Canada. And due to the short duration of Visa and marriage function due you were unable to follow all the immigration procedure of your spouse. Then ask them whether there will be any problem if you want to sponsor your spouse within Canada?
Remember to mention your file number, full name, date of birth and attach a copy of our landing paper.

So at the time you made your application for permanent residence you were married and did not include her on the application and have her examined? The application clearly shows that you have to indicate your spouse even if she is not accompanying you. If this is the case, I think PMM is right and you have a serious problem.

Hi PM,
If that is the case then why they didn't mention this clearly. I didn't know this thing and I am sure there are many people don't know about this complication. They confused me then, why did they mention in the last paragraph that because the visa validity date cannot be extended so you can sponsor your wife from Canada. How I can sponsor my wife then. if you are saying that I cannot sponsor my wife.

Another thing is. I haven't received my pr card yet and I am new immigrant. I should received it within 30 days. I have to travel to UK urgently now. Is this ok to travel without the PR Card and then when I will come back to Canada, I will get the Travel Document from the Canadian Embassy in UK.

Please advise is there any risk that they will not issue me the Travel Document.

I highly doubt many people don't know about this "complication". The rules are made very clear to understand both in the instructions and the correspondance you get from CIC upon receiving your PRV.
