sponsoring a child born to PR holder outside of Canada

Hi everyone,

All family members are PR holders, landed and left Canada with the intent to return within a 3 year period to live permanently. While abroad a child was born. Now the family is planning to return to Canada. We understand that the sponsorship of non-PR child can be done when the principle PR holder is in Canada. The question is how to bring the non-PR child to Canada together with the family? Under a visitor visa? And then when in Canada start the sponsorship procedures?

The primary PR holder does not have to be in Canada in order to sponsor the child - but either the mother or father needs to be (assuming both parents have PR). You can apply for a TRV for the child. If the TRV is refused you can try applying for a TRP. If the TRP is also refused, then either the mother or father will have to travel to Canada ahead of the family to submit the sponsorship application and then remain in Canada while the application is being sponsored.

The primary PR holder is father. The child is 2 years old. The whole family (all have PR except the child) is outside Canada and a 3 year period will end by May 2016. So the family wants to return to Canada by May 2016.

1. So the father applies for a TRV for the child. If it is issued for how long it is valid? Can the whole family then travel to Canada and the father as primary PR holder will then apply to sponsor? Even if the TRV gets expired?

2. If the TRV is refused, then the father applies for a TRP for the child. If it is issued for how long it is valid? Can the whole family then travel to Canada and the father as primary PR holder will then apply to sponsor? Even if the TRP gets expired?

3. What would be the right course of action if both TRV and TPR are refused?

Hi. Please let me know what happened in your case. I have a similar situation and I am waiting for the TRV to be processed. I hope everything worked out well.
