hi guys,,
this question is concerned about a friend,,,
She was on welfare about 3 months ago and she wants to know if she can sponsor her husband,,,,does she has to pay back the money?

First of all, she has to be off welfare immediately to sponsor. As far as I know, she doesn't have to repay the money, but she has to off welfare immediately AND also has to get a letter from the government saying that this person is officially off the welfare list. This last part is very important becuase many people here have been refused despite going off welfare, because they didn't get such a letter.

Sure a letter from employer will help in general, but that won't matter if CIC still thinks she's on the list of active welfare recipients. She needs to end her welfare IMMEDIATELY, and then follow up with the welfare office to ensure she is officially off their list, and get a letter stating that.

She can also expect a longer processing time for stage 1/sponsr processing due to this.

Even if she was to get off welfare and off list, CIC could still refuse to approve her as sponsor as they want the sponsor to be off welfare for past 12 months. Option C printout will show that the sponsor has been on welfare. So this may cause CIC to refuse to approve her as sponsor until 12 months of no welfare has passed. Doesn't always do this but there has been cases sponsor has been approved despite being off welfare since a month earlier and cases whereby despite being off welfare a month ago, sponsor has to wait 1 year before qualifying again.

No, there is no such rule that states this. Only that one needs to be off welfare at the time the app is submitted.

The problem people have had in the past is that the welfare office doesn't properly take their name off the recipient list even though they stopped getting payments, so when CIC does their investigation they still think they are currently on welfare, and simply reject the app. It's not due to any 12 month rule.

If Option C printout shows that the sponsor has been on welfare, does CIC have ground to disqualify sponsor for approval? Isn't that the purpose of CIC asking for Option C printout, to show that the sponsor hasn't been on welfare at all.

No that is not grounds for sponsor rejection. It is just grounds for CIC to start their investigation into the sponsor's welfare use. In most cases of rejection, it turns out the welfare office didn't properly remove the sponsor from their recipient list, meaning CIC thinks the sponsor is still on welfare, and then rejects them.

OP manuals say one only needs to be off welfare at the time of application. There is no 12 months rule stated anywhere.

sir , plz answer my question. I claim here asylum and within two month my case has been accepted my case was real, so after that I applied for my PR and sponsor also my family + three kids , now I have received PR in August 2014 but my question is I am still on welfare and my family file is transfer to my home land country pak did cic give the visa to my family ?

You cannot be on welfare at all. Your family PR sponsorship will be in serious jeopardy if CIC finds out you are still on welfare, more likely to cancel / abort your family PR.

Hello there

My question is: I was working part-time in a contract position and receiving welfare ( my welfare worker was fully aware) because they Were giving me what's call a top because I was working part time. Now because i will be sponsoring my spouse I totally came off of welfare approx five months ago as well as becoming permanent in the company.

Will this denied my application to sponsor because I came off five months ago. I don't know what to believe, I heard you have to be off of welfare for 12 months before you can sponsor and in my case I was always working but receiving welfare as a top up (which I'm assuming is still considered as a welfare recipient ????

Again I am totally off now and working full time permanent since August 2014 and want to send my application in for January 2014 ????

What do think ???

When I request for the option c I am more than sure it will state something to do with welfare because I was on it from January 2014 to August 2014 then became permanent in my company. Again I was still working part time at that same time frame of January 2014. to. August 2014 ??

You'll be using the 2013 tax year option C so it might not show. Even if it does provide proof of your current job and that it is now a permanent position.

You need to call the necessary welfare office and confirm that they're indeed taken your name off their official list of welfare recipients. It would be good if they could also send you some kind of letter that states the date you were officially removed. There have been several posts on this site from people who were off welfare at time they submitted the app, but their names were accidentally left on the recipient list so they were rejected as sponsors.

Not sure if it matters much if your Option C will state you were on welfare. CIC will probably know anyways and do their own investigation. You should expect longer processing time for sponsor approval, but as long as you were off welfare at time of the app then you should get approved.
