I would like to know the process for applying PR for my spouse studying in USA on student visa (holds Indian passport).

Should we send application to New Delhi office or a visa office in USA?

Processing times for New Delhi office is 13 months now and in USA it is 26-30 Months.

She holds a visitor visa expires in 5 yrs

Please help.

If you read the guide, you'll see USA residents are processed in CPC-Ottawa. http://www.cic.gc.ca/english/inFORMation/offices/apply-where.asp

Technically she qualifies for both offices, so could choose CPC-Ottawa based on residency or New Delhi based on citizenship. It's probably better to choose CPC-Ottawa, since then any potential interview would be in the USA. If app went to ND, then if there's an interview she'd need to fly back to ND to attend it.

No matter which you choose, CPC-Mississauga may decide on their own to send it to either place. So just be prepared even if you select CPC-O, CIC may still send it to ND for processing.

Thanks very much for your reply.

Currently, she lives in Detroit and once the application has been submitted, would there be any problem if she travels (she has TRV) between Detroit and Toronto very often?

As long as she has TRV to Canada, there is no problem if she travels for visits to Canada.

To cross Canadian border, she should bring proof of PR application in progress (after its submitted) and proof of ties to USA (such as ongoing school enrollment).
